Dear Local Government Ombudsmen,

In April 2010 I submitted a complaint to the LGO relating to
Stockton Borough Council's handling of my concerns over Hadrian
Park Care Home TS23 3DF. Unfortunately as I was not a relative or
representative of the vulnerable person I had concerns for I was
told that I could not make a complaint. My concerns were the
handling of medication and unsuitable staff.

Can the Ombudsman confirm that when Stockton Borough Council
forwarded correspondence it included a letter which I received from
Lorraine Goude which was wrongly dated 2009 and filled with typing
errors. The letter was quite threatening.

The Care Quality Commission carried out 5 inspections between June
2010 and February 2011 at Hadrian Park and issued a Warning Letter
dated 7 July 2010 listing eight regulatory breaches, one relating
to the handling of medication and another relating to the fitness
of workers employed at the home. Because I continued to email the
Council about my concerns prior to these investigations Jane
Humphreys, Corporate Director of Children, Education and Social
Care imposed a block on my email address and threatened to show my
emails to the police. Had it not been for the unannounced
inspections by the Care Quality Commission the residents would have
remained at risk as Stockton Borough Council refused to look at
concerns which were clearly regulatory breaches.

In September 2010 I received a letter from Stockton Borough Council Law and Democracy informing me that I am vexatious. The reason I have continued to contact the Council and make FOI requests is out of anger and frustration that the Council refused to act on my concerns. The CQC inspections at the home were not carried out as a result of my concerns.

Some reality surfacing at last! An article from this morning’s Telegraph.

Could be worth keeping an eye on Lansleys performance today. General concenus: “Why should Lansley speak with the Nurses? Because that's his JOB. That's partly why we pay him over £100 Grand a year and if HE can't explain in words that nurses can take on board and understand why so many of them need to loose their jobs whilst their non-clinical Managers sit it out, then he shouldn't be in the job. If Dave and George are really committed to cutting waste from the Public Budget, I think we've found our first candidate.”

A little light at the end of a very long tunnel….or maybe just another mirror! But “The structures are there - unfortunately too many managers are appointed from clinical specialities with little or no training in management and those that have some ability get constantly denigrated by the media as a drain on resources compared to the "wonderful nurses & doctors" on the "frontline” But some with no ability employ the wonderful doctors and nurses…..and also are responsible for assessing competency!

“And it isn't all the managements fault - how many times have professional bodies like the GMC, (PHSO!)and the like turned a blind eye and hushed things up to avoid rocking the boat. If the management don't even know what their own policies are and can't apply the ones they do have fairly it's hardly surprising no-one ever gets blamed.

Then of course sometimes the blame properly belongs higher up - impossible targets, chief executives and ministers desperate to "tick a box" for the next press release, staff encouraged to "bend the rules" to make sure it looks good for the media even if it isn't.

It's not the money we spend on managers that's the problem - it's the managers we spend the money on.”

How true!!

This is a paragraph from a letter I received from Jane Humphreys, Corporate Director of Children, Education & Social Care on 21 May 2010.

"I have a duty as a responsible employer to consider the adverse impact of these emails on staff and take appropriate action if necessary which may include passing on the content of your emails to the Police"

One week after this letter my email address was blocked. 2 weeks after this letter Hadrian Park was inspected.

I have just received a response to a FOI request I made to the CQC asking how many inspections were conducted at Hadrian Park Care Home since September 2006 where a Specialist Pharmacist Inspector was present and there have been only two on 15 July 2010 and 16 September 2010. It seems Stockton Borough Council did not investigate my concerns about medication due to the fact that I was not a relative of the person I raised concerns about. This should have been investigated under safeguarding and the fact that I am not a relative is irrelevant.

How can an Ombudsman say I am unable to make a complaint because I am not related to the person I have concerns about? Does this mean that if I witness a vulnerable adult being abused in the street I should turn a blind eye? I wonder how many vulnerable people have suffered at Hadrian Park Care Home or even died as a direct result of medication errors which could have been prevented if Stockton Borough Council had acted appropriately and requested a pharmacist inspection.

According to a number of Councils that I have now contacted, they would all consider concerns relating to the handling of medication in a care home from anyone and not just the next of kin, they would consider and investigate under their policies and procedures.
