Dear Sir or Madam,

Under the FOI Act 2000, I would like to know how many teachers, and
Head Teachers have:

1) Signed a compromise agreement since September 2004.
2) How many of these resulted in the termination of their
employment with yourselves, the council.
3) How long they had been working for the Educational Service in
your Council.
4) How old they were on their day of leaving.
I would be grateful if you could let me know if there is a cost to
this request.

Dear Ms McArthur

Freedom of Information request - IGT_FOI_11_2398 - Compromise Agreements

The Council has decided that your request for information will not be
processed on grounds of cost.

It is estimated that the cost of locating and retrieving the information
requested calculated according to the government's Freedom of Information
(Fees and Appropriate Limit) Regulations 2004 would cost approximately
£750 (5 working days) which is in excess of the upper limit of £450 set
in the Regulations 2004.

Section 12 1(1) does not oblige a public authority to comply with a
request for information if the authority estimates that the cost of
complying with the request would exceed the appropriate limit

In accordance with the Freedom of Information Act 2000 this letter acts as
a Refusal Notice.

If you have any queries please get in touch with me to discuss them. You
might like to know that the Council's website [1]www.towerhamlets.gov.uk
contains a section on the Freedom of Information Act that lists other
publications readily available from the Council under its Publication

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Tower Hamlets Borough
Council's handling of my FOI request 'Compromise Agreements Signed
by Teachers and Heads since 2004'.

I wish to ask for an internal review to supply me with the
information I have requested, and ask that you re-consider the
costs involved in supplying this information.

Most other Councils from whom I have had a response or an
acknowledgement, have either supplied me with this information, or
are reviewing their position at no extra cost, all within 20 days.
All their responses are online and are in the public domain through
this web site.
As well as this information being of value to me, I believe that
this information is of great value to the public. Public money is
utilised in reaching these agreements, and therefore I stronger
consider that this information should be in the public domain.

In section 16 of the FOI Act, authorities are asked to provide "
advice and assistance'. Please let me know if a particular aspect
of my request is difficult, and if so, perhaps you would consider
responding to a part of my request.

Dear Ms Jones,

If at all possible, I would rather this be kept in the public
domain, which is acceptable by the Commissioner as in the
Guidelines from the Ministry of Justice state;

– "As well as hard copy written correspondence, requests that are
transmitted electronically (for example, in emails) are acceptable
... If a request is received by email and no postal address is
given, the email address should be treated as the return address."

I have no objections to my email address being forwarded to your
complaints department for this purpose.

Ms MacArthur,

Whilst you are correct concerning an email address being a valid means of
communication for the request, we do insist on a postal address as part of
our Corporate Complaints procedure. Naturally we would suggest that you

'What Do They Know'

Dear Ms MacArthur,

Thank you for your email of 2 January 2010

I am sorry that there hasn't been a substantive response to your request
for an internal review on 1 December 2009. I have been assured that this
will be forthcoming in the next 5 working days, and can only apologise for
the delay in completing this matter.

Without pre-judging the result of the internal review, we have clearly
stated that the cost of dealing with this request, in accordance with the
Fees Regulations, is above the appropriate limit. Whilst I appreciate
this is frustrating, the regulations exist to regulate the time spent on
each request.

You should receive the response to your complaint by 12 January, and
apologise once again for the delay in dealing

Dear Mr Tim Rogers ( or Tower Hamlets Borough Council FOI Officer)

I have had no communication from you since 5th January despite me
complying with your requests of 01.12.09 to supply you with my
postal address by fax which I did on 3.12.09, Furthermore, I have
no response to your assurance in your email dated 05.01.10 that I
would get a response in the following 5 days to my FOI Request.

I am unclear whether you have complied with following your
procedures to ensure that my request for an Internal Review has
been sent to the appropriate person/s in Tower Hamlets.
You state in your email dated 5th January;
' Without pre-judging the result of the internal review'. This
shows that to date, the Internal Review has a not occurred as I
have had no response by postal mail, nor on this public web site.

I would appreciate you clarifying the situation so that I may
consider my position.
