Dear Sir or Madam, On the 01/10/07 Aberdeen City Council had a
meeting on Adult Health and Care. Resulting from this meeting a
report was produced entitled A Strategy for Transforming Adult
Services – Health and Care for 2007 to 2010. On the back of this
report there would be a completed strategy including an Equalities
Impact Assessment. Item Page 9 under Human
Rights/Equalities/Diversity on the report of 01/10/07 states The
completed strategy will include an Equalities Impact Assessment. I
would like a copy of the completed strategy including the
Equalities Impact Assessment in whatever format available.

Dear FOI Enquiries Team, Resources Management (City Solicitor),
Aberdeen City Council.

You sent the copy of the Adult Health and Care strategy to the
wrong FOI question.You stated in that reply the Equalities Impact
Assessment will not be available till the 27th October 2008.

Therefore the questions I need answered is; was there no Equalities
Impact Assessment produced after the original strategy in October
2007 and prior to many changes and closures in Adult Health and
Care including Choices day service.Which the closure of began in
February 2008. Is The Impact assessment being prepared and
available on 27/10/08 the first true assessment produced on the
actual impact on the closures instrumented in the Adult Health and
Care strategy produced on October 2007.

Dear Ms Domeracki,

Thank you for your emails received this morning. I apologise I treated
your two enquiries as one in my previous response.

Please see below response to your email of this morning:

Enquiry:
"Is The Impact assessment being prepared and available on 27/10/08 the
first true assessment produced on the actual impact on the closures
instrumented in the Adult Health and Care strategy produced on October
2007"?

The closure of Choices was a result of decisions taken as part of the
February budget, and an EHRIA has been completed on all these budget
decisions on 07/05/08. Impact assessments were undertaken on all the
recommendations contained in the Adult Transformation Strategy as part
of the strategic analysis process which took from May 07 through to
September 07. What we need to do, and have not been unable to do due to
annual leave, is to bring these assessments together into one document
following the EHRIA format that can be sent to Ms Domeracki. This task
will be completed by 27/10/08.

I will not close this enquiry until we ensure the completed EHRIA is
available to you. If you are not happy with this response please see
below the Further Information Notice informing you of your rights under
FOISA.

FURTHER INFORMATION

Aberdeen City Council’s Complaints Procedure under the FOISA

An applicant who is dissatisfied with the way in which Aberdeen City
Council has dealt with his/her request for information under section
1(1) of the FOISA regime, may, by virtue of section 20 of the FOISA,
require Aberdeen City Council to review its actions and/or decisions in
relation to that request.

If you wish Aberdeen City Council to review its actions and/or
decisions with respect to your request for information, you should write
to the City Archivist, Resources Management, Aberdeen City Council, Old
Town House, Broad Street, Aberdeen, AB10 1AQ. The City Archivist will
arrange for your application for review to be considered by the Review
Panel. The Review Panel will write to you informing you of its decision
by not later than twenty working days after receipt of your request
requiring that a review be made. By virtue of section 21 of the FOISA,
the Review Panel will also provide you with a statement of its reasons
for arriving at the decision it has made.

Your request for review should reach Aberdeen City Council by no later
than 12th December 2008. Your request for review must be in writing (or
in another form which has some permanency and is capable of being used
for subsequent reference i.e. audio/video tape recording). You must
state your name and address for correspondence. You must also give
details of the information which you originally requested from Aberdeen
City Council, and must state the reasons why you are dissatisfied with
the way in which your application for information has been dealt with.

Your Right to Complain to the Scottish Information Commissioner

By virtue of Section 47 of the FOISA, a person who is dissatisfied with
a Notice issued by Aberdeen City Council under Section 21 of the FOISA,
may apply to the Scottish Information Commissioner, for a decision as to
whether, in any respect specified in that application, the request for
information under section 1(1) of the FOISA, has been dealt with by
Aberdeen City Council in accordance with Part 1 of the FOISA.

An application to the Scottish Information Commissioner must be made in
writing (or in another form having some permanency ie a video/tape
recording) within six months of receipt of a section 21 Notice by the
applicant. An applicant must state his/her name and address. An
applicant must also specify: -

- the request for information to which the requirement for review by
Aberdeen City Council relate;
- the matter which gives rise to the applicant’s dissatisfaction
pertaining to the applicants request for review;
- the matter which gives rise to the applicant’s dissatisfaction
pertaining to the decision given in the section 21 Notice.

Dear Foi Enquiries, In your reply it states that Quote:

Does that mean there were assesments produced prior Adult Health
and Care strategy produced on October 2007?

You also state that assesments were made on the Adult Health and
Care strategy produced on October 2007, but the EHRIA will not be
produced until 27/10/08 a year after due to the annual leave.Was
this year off taken by both authors and 7 others involved in the
production of the Adult Health and Care strategy?

Dear Mrs Domeracki,

Thank you for your email.

The Adults Transformation Strategy was developed between May 07 and September 07, and as part of this process, the team looked at the implications of the proposals that went forward, and some proposals that did not make there way into the final report.

As explained in a previous email, this analysis was not brought together into one EHRIA document. This has now been completed, and the documents shared with yourself.
