Dear Sirs,
Thank you for your response today to my recent Freedom of
Information Request. You state within your response that you do not
provide a route of internal review where you have decided not to
release information on the grounds that you have done so on this
occasion.
However, I wondered if you might be so helpful as to clarify a
matter before a decision is taken as to whether the matter is
raised with the Information Commissioner or not.
Your response fails to recognised that the BBC might receive
complaints that do not relate to the output of the BBC and would
therefore not be information held for the purposes of ‘journalism,
art or literature.’
Can the BBC confirm that it holds no complaints for the period
enquired about that do not relate to the output of the BBC or would
otherwise relate to ‘journalism, art or literature’?
For the avoidance of doubt a complaint would be any expression of
dissatisfaction that is held in a recordable format.

Dear Mr Sloan,
Please accept our apologies. We receive requests for information about editorial complaints on a daily basis and rarely, if at all, receive requests relating to any other type of complaint. We therefore intepreted your request as relating to editorial complaints.
If you are wanting copies of all complaints of any nature received by the BBC it would take more than 2.5 days to locate the information you are requesting. The BBC has procedures and structures in place to receive, respond to and track editorial complaints. However, because complaints that are not about content are rarer, there is no such structure in place for them. They could come in through any channel and be handled by any department or member of staff (for example a complaint could be made to a local office about where a BBC vehicle has been parked, or a complaint could be made to a particular manager about the behaviour of a member of his department and the matter could be dealt with informally); therefore we consider it highly likely that to a) determine if any information is held (i.e. by contacting all of the BBC's 17,000+ staff) and b) locate any information about the complaints would take more than 2.5 days; under section 12 of the Act, we are allowed to refuse to handle the request if it would exceed the 'appropriate limit'. The appropriate limit has been set by the Regulations (SI 2004/3244) as being £450 (equivalent to two and a half days work, at an hourly rate of £25).
If you are interested in a particular type of complaint please let us know and we are happy to reconsider your request under the original request reference and within the original timeframe.

We re-opened your request following your email below. However, unfortunately our FOI contact for Scotland has been on leave since we contacted him up to and including today's date therefore we will not be able to respond to your request in time to meet your original request deadline.
