Dear Sir or Madam,
Could you provide the amount paid out to indiviauals within the
City for compensation claims against the council?
These would include type of claim (vehicular-to cars or by cars,
trip, fall, or gross misconduct -maladministration etc)and the
amount of claim.
Also, could you provide 'out-of-court' settlements for payments
made to individuals whilst in the process of such an action.

Dear Iain
Thank you for your request regarding compensation claims which we
received on the 15th May 2009.
The council wants to be as open as possible in answering requests and to
help people obtain the information they are looking for.
Your request will be considered under the Freedom of Information Act
2000 however at present it does not have sufficient clarity for us to be
able to proceed. Please answer the following questions:
1. What time period which are you interested in? (e.g. Financial year
08/09)
2. In terms of time period, are you interested in the date that the
claim was made or the date on which it was paid? (these can cross
financial years)
3. Do you require details of unsuccessful claims as well as successful
claims?
4. Please clarify what you mean by "Out of Court Settlements".
5. Please specify whether you would like this information on an
individual claim basis or broken down by type of claim.
Please be aware that if you are requesting this information on an
individual claim basis this would involve a substantial amount of
information. Gathering it together would therefore be likely to involve
a significant cost and diversion of resources from Coventry City
Council's other work.
This could mean that we might have to charge you for the work involved
or even have to refuse the request under the exemption in section 12 of
the Freedom of Information act 2000, covering requests where cost of
compliance exceeds the appropriate limit.
Given the above, the best way that we can help you is therefore to ask
you to consider whether you could narrow down your request to focus on
the precise information you are seeking.
On receipt of your narrowed down request the Council will assess your
request and provide the information if possible. The working days taken
for you to respond will be added to the existing deadline.
If you are unable or unwilling to narrow down your request the Council
will, of course, consider it in accordance with our obligations under
the Freedom of Information Act 2000. However we wanted to give you an
opportunity to reconsider your request and describe more precisely the
information you wish to have.
If you have any other issues relating to this request please do not
hesitate to contact me.
Please let me know how you would like the Council to proceed.

Dear Anthony Mann,
Many thanks for your reply, I'm glad to hear the council have
adopted an 'open' attitude to information requests. In the light of
current political news, I believed this is prudent.
To clarify the original question;
1. The financial year 08/09
2.Payments during this period made, not on-going claims
3. Details of unsuccessful claims would be appreciated
4. Compromise reached between the parties to a legal dispute. Most
civil legal actions are settled out of court, reducing legal costs
and avoiding the uncertainty of the outcome of a trial. Therefore,
payments made after litigation's are initiated, but a decision
wasn't reached by a court, rather a payment settlement in agreed
upon between claimant and the council
5. This would be best on an individual claim basis, as I will be
able to collate the figures to make the ' total type of claim' from
these figures
Judging by the amount of monies floating around the average MP's
wallet at the moment, I would assume the costs involved in this
type of information harvesting would be negligible in comparison.
