Edinburgh Council and Alan Marks Tree Surgery (registered address: 36
Caroline Terrace Edinburgh EH 12 8QX) pertaining to 43-59 Montpelier Park
EH10 for period 1 January 2009 to date.")

I need you to advise me why you think you should have access to this
information.

Correspondence between the Council and a private individual or other
person is confidential and cannot be provided to a third party under
Section 36 and possibly Section 38 of the Freedom of Information Act
unless express permission is given to do so by the data subject.

Can you also provide me with information concerning the meetings you
mentioned? The Council is a large organisation and provides forums for
many groups across various departments and services. What was the topic of
the meeting and who hosted it?

The Council need not provide any information until clarification is
received and this must be within three months of the issue of the notice.
Please note the Council will issue no further correspondence requesting
this clarification. In the event of the clarification not being received
within the allowable three months, this request will be closed. The issue
of this Clarification Notice has the effect of "stopping the clock", in

Dear Services for Communities FOI,

In relation to FoI 42836, I am seeking this information in
connection with the destruction last month of a healthy 100 year
old tree situated in the back green of the properties 43-59
Montpelier Park EH10. The tree was cut down by Alan Marks Tree
Surgery. I want access to the correspondence between the Council
and this company concerning the destruction of the tree, so that I
can ascertain whether there has been compliance with correct legal
and other procedures.

In a separate FoI request (42929), I am seeking access to
communications between the Council and residents/tenants of 43-59
Montpelier Park EH10 about the same topic. In particular, I wish to
find out who made the request to have the tree cut down, what
grounds were given for this, and what claims were made by
this/these person(s) about the views of other tenants/residents
about the destruction of the tree.

Dear Mr Platt,

With regard to your requests dated 2 June 2009 please find attached all of
the correspondence held with this department. All communication was with
the agent (Mr Marks) appointed by the resident of Montpelier Park. The
notification of intent to carry out tree work in a conservation area
served on the Council on 2 April 2009 by email, this was deleted after
responding.
