Dear Sir or Madam,

Please provide copies of any document held by the Parliamentary and
Health Service Ombudsman related to:

(a) authorisation of the Chair and Vice Chair of the Commission for
Local Administration in England (CLAE) to make decisions on their
behalf e.g. adoption of a new Code of Conduct and removal of the
Code on Access to Information in October 2008 and such like,

(b) any failure of any member of the Commission for Local
Administration in England (CLAE) to follow the Code of Conduct
adopted by the CLAE;

(c) any failure of any member of the CLAE to register their
interests properly (e.g. employment at the University of London);

(d) any issues related to the administration of the CLAE that the
Parliamentary and Health Service Ombudsman has raised with the
Secretary of State and their department related to issues with the
CLAE Code of Conduct;

Dear Mr Hardwick Carruthers

I write in response to your information request of 1 September 2009 for
"copies of any document held by the Parliamentary and Health Service
Ombudsman related to: (a) authorisation of the Chair and Vice Chair of the

The Parliamentary and Health Service Ombudsman does not hold any documents
in relation to her role as member of the Commission for Local
Administration in England. It follows that the Ombudsman does not hold
the information you request and therefore I cannot release the documents
you seek.

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Parliamentary and
Health Service Ombudsman's handling of my FOI request 'CLAE Code of
Conduct'.

A full history of my FOI request and all correspondence is

The Parliamentary Ombudsman has previously identified that they do
hold CLAE documents in their role as a Commissioner.. It seems very
odd that the Parliamentary Commissioner would not have a copy of
their own code of conduct as a member of the CLAE.

'The Parliamentary and Health Service Ombudsman does not hold any documents in relation to her role as member of the Commission for Local Administration in England.'

That simply cannot be true. If it was she wouldn't even know she had a role or what her role was.
