Dear Sir or Madam,
Can you supply any information that you hold on whether a defence
lawyer [part time judge] working on behalf of the Department of the
Environment [Animal Health] in a civil case can wait until minutes
before entering the court room before serving the defence papers
onto the claimant’s witness in relation to a claim for illegally
charging a member of the public to register a hybrid falcon that
did not need to be registered?
Furthermore, do you hold any information on whether or not the
judge in the case above, when asked to adjournment the case to read
the ‘ambush defence’ followed the correct procedure by saying "keep
quiet" to the claimant and ignoring the topic brought to the
judge’s attention that the defence papers should have been
disclosed at a reason date before the trial as the claimant was
ordered to do? I am also interested in any information that you may
hold in relation to aforesaid matters to the extent my right to a
fair trial was violated [Art 6]
Do you also hold any information on whether the government can
retrospectively make illegal charging to register hybrids falcon
legal years after the crime was committed [fraud]?
