Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your e-mail dated 10th December 2009 in which you requested
a review of the response to your request for access to certain information
which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

***Dear Sir or Madam, could you please tell me if you get convicted in a
civile court of crimnle damage is this an offence and would this be
technicl be called a crime."

Your request for review asked:

***Dear Northumbria Police, can you tell me if you know about the civle
court case in volving the rspb and shurrock and them haveing to pay mouny
to mr marshall given the fact you are useing him and leting him have
controll of evedence unsuperviced and leting him do wot he wonts and going
on raids when his name is not on worents giving the fact he has been
prooving to be a lyer as there is a larg amount of evedence to proove it
just read the court transcript in the chris marshal case or would you like
me to put them on here so you can read them.***

Your request is clearly regarding information connected to Criminal and
Civil Court legal procedures. Northumbria Police are not responsible for
these procedures and as such cannot offer you any response to your
question. Our initial response suggested that you may wish to direct your
query to a Civil Court rather than this department. This review has come
to the same conclusion. You have not requested ***recorded*** information
from Northumbria Police and as such, Northumbria Police is unable to
provide you with a response under this legislation.

Your request for review relates to information in connection to a specific
civil court case. A Freedom of Information request is not the correct
forum to raise queries on specific court cases. It may be worth noting
that the Information Commissioner has stated that using Freedom of
Information to re-open long running disputes is inappropriate. A Freedom
of Information request is also not the correct forum to make complaints
about Police Officers, Police staff members or members of the public.

This concludes my internal review into your request under the Freedom of
Information Act 2000. If you remain dissatisfied with the outcome of this
review then it remains open to you to refer this matter to the Information
Commissioner at the following address:

The Information Commissioner***s Office
Wycliffe House
Water Lane
Wilmslow
Cheshire
SK9 5AF

Yours sincerely

Superintendent Mike Jones
