Dear Crown Prosecution Service,
Dear Her Majesty’s Crown Prosecution Service Inspectorate,
What are the charging standards for cases of assault and false
imprisonment against members of the public by security personnel
and store detectives?
Is some degree of physical restraint tolerated even where there is
no clear evidence that a person has stolen or attempted to steal
merchandise?
Is the degree of suspicion relevant?
Is lack of apology by the individual concerned or their employer
considered an aggravating circumstance?
Would the employer being a high profile retailer be considered
grounds for an exemplary prosecution?
If the police have clear evidence of any degree of force being used
to stop and detain a suspect where the individual concerned (ie the
one who did the stopping) do they in the view of the CPS have any
discretion on whether to refer the matter to the CPS?
