Dear UK Border Agency,

I have a request under Freedom of Information (FOI) law to UK
Border Agency regarding changes to the charges for Immigration and
Nationality Services.

Before April 2009, SET(O) Giudance used to have disclaimer:
"In accordance with the 1961 Council of Europe Charter or the 1996
European Social Charter (revised), nationals of countries which
have signed and ratified the charter are exempted from the
requirement to pay"

However, since April 2009, SET(O) Giudance
(http://www.ukba.homeoffice.gov.uk/siteco...)
says :
"The fees for nationals of countries which ratified the 1961
Council of Europe Social Charter (CESC), ie Croatia, FYR Macedonia
or Turkey, are different"
"Nationals of the countries which have ratified the 1961 Council of
Europe Social Charter pay a reduced fee."

According to “The Immigration and Nationality (Fees) Regulations
2010“ (Draft Regulations laid before Parliament under section 42(7)
of the Asylum and Immigration (Treatment of Claimants) Act 2004,
for approval by resolution of each House of Parliament.)
(http://www.opsi.gov.uk/si/si2010/draft/p...),
articles 10(1)(b)(ii) and 10(1)(e)(ii):
there is proposed a reduced fee for the application Indefinite
Leave to Remain in the United Kingdom, where "the application is in
respect of a person...who is a national of a state which has
ratified the Council of Europe Social Charter"

Obvously, the countries which have ratified the 1996 European
Social Charter (revised) are now removed from the list of
exempted/reduced fee countries.

Please, confirm: can you explain the reason why countries which
have ratified 1996 European Social Charter (revised) are removed
from the list? (unlike countries which have ratified the 1961
Council of Europe Social Charter)
Please, confirm: Is this removal legal in accordance with the 1996
European Social Charter (revised)? Is it reasonable and fair?
