Dear Disclosure Scotland,
The English CRB system is making changes and I wonder if these will
be applied to Disclosure Scotland to prevent discrimination.

As can be seen one of them being : a method will be developed for
filtering out older and minor convictions so that they will no
longer be revealed on a CRB check
Will this apply to Scotland, if not why?

Thanks for your email I hope the information below is of use to you.
The legislation in Scotland has already been changed and the Protecting
Vulnerable Groups (PVG) Scheme went live on the 28^th February 2011. This
Scheme has replaced the enhanced disclosure process for those doing
regulated work with children and/or protected adults in Scotland. The PVG
Scheme is completely separate to the proposed changes to the CRB system.
More information on the PVG Scheme can be found [1]here.
The majority of Scottish convictions are held on the Criminal History
System (CHS) which has a weeding policy for removing `older and minor'
convictions so they would no longer appear on a disclosure, PVG or CRB
check. The majority of convictions are subject to the 40/20 rule which
means they are held on an individuals record until they turn 40 years old
and the conviction is 20 years old, or whichever is the longer of these
two periods. Once these criteria have been met the conviction is
automatically removed from CHS.
