Under the Freedom of Information Act, I kindly request the
following information in relation to day services for adults with a
learning disability in your local authority:
1) How many adults aged 18-65 with a learning disability were known
to social services in a) 2009/10, b) 2010/11 and c) 2011/12?
2) How many adults aged 18-65 with a learning disability attended
day activities in a) 2009/10, b) 2010/11 and c) 2011/12:
i. 5 days a week or more
ii. 4 days a week
iii. 3 days a week
iv. 2 days a week
v. 1 day a week
vi. 0 days a week?
3) How many adults aged 18-65 with a learning disability attended
the following type of day activities in a) 2009/10, b) 2010/11 and
c) 2011/12:
i. day centres
ii. employment
iii. education
iv. voluntary work
v. other activities?
4) How many a) day centre places and b) equivalent day service
places for adults aged 18-65 with a learning disability were funded
by the local authority in the following financial years:
i. 2009/10
ii. 2010/11

We have not currently had any day service closures and there have not been
any consultations. However we are unable to answer any other questions
for the reasons explained below.
Finding, retrieving and preparing information takes employees’ time and
consequently we are allowed to consider costs. The Freedom of Information
Act contains provisions in section 12 to protect public authorities from
having to respond to requests that are highly time consuming. This is on
the basis that if authorities were required to spend an unlimited time on
these requests then the provision of their day to day services would
suffer.
In effect this means that there is a finite amount of time that an
authority is required to spend locating and retrieving information for any
given request. This is set out in regulations and for authorities such as
the council it equates to 18 hours in any 60 day period. The relevant
regulations are ‘The Freedom of Information and Data Protection
(Appropriate Limit and Fees) Regulations 2004’.
After considering your request about learning disability clients and day
services, it would be appear to take a considerable amount of time as
there is a requirement to collect data over three consecutive years. The
total time would be approximately 5 days. It may be possible to complete
numbers 1, 2, and 8 within 18 hours. Numbers 3, 4, and 5 would require
more time as the data would need to be extracted from a number of areas,
probably the same amount again. Therefore we are refusing to search for
the information and are relying upon section 12(1) of the Act.
However, if you were able to reduce your request in scope to bring the
total search time to below 18 hours it may be possible to supply some
information that may be of interest to you, for example resubmitting
questions 1, 2 and 8.

financial assessment-differential charges for older people centres,
Centres for people with a learning disability and Centre for people with a
