Dear Torridge District Council,
Reference The Sports Ground, etcetera
In the Bideford Post, August 2,010, it states that "Torridge
District Council registered themselves as owners of the Sports
Ground at the time (2007) as they registered a whole host of
properties in the Bideford & District area . . . the solicitors
representing the Land Registry had been satisfied that Torridge had
supplied 'sufficient evidene of the title' to all properties
registered at the time". Under the Freedom of Information Act, what
was the evidence supplied to the Land Registry for the all of the
properties concerned, including the sports Ground?

Dear Robin
I refer to your Freedom of Information request send on the 9th August 2010 enquiring what evidence was supplied to the Land Registry when Torridge District Council were registered as owners of the Sports Ground and various other properties in the Bideford & District area and would reply as follows.
When registering our properties we provided evidence of title to Torridge District Council or it's statutory predecessors. In the majority of cases, including the Sports Ground, the type of registration is Title Absolute evidenced by a conveyance or transfer of the land. Title to the Sports Ground itself is evidenced by a conveyance between Bideford Sports Ground Ltd and the Mayor Aldermen & Burgesses of the Borough of Bideford (being TDC's precursor) dated 24th June 1946. In some cases where we do not have deeds to evidence our title, we provide statutory declarations to evidence that the land or property had been in the Council's ownership for 12+ years to give us Title Possessory.
In all instances, the registration of Land and Property is a strict process legislated by the Land Registration Act 2002 and the Chief Land Registrar must be satisfied that the evidence provided meets the statutory requirements of the act.
Like any individual or organisation, the Council's title is available publicly at the Land Registry to view.

If your complaint is not resolved to your complete satisfaction, you have the right to apply to the Information Commissioner for a decision.
