Dear Trafford Borough Council,
On Kings Road, Stretford, Manchester, on the south side of this
road, just to the east of the small alleyway leading to Longford
Park, the third tree east from the junction of Kings Road and
Cromwell Street, there is a large tree. This tree is surrounded by
a tarmac type surface on the pedestrian walkway, which is out of
kilter with the rest of the the area which uses paving slabs.
Can you please furnish me with any and all information held about
this different surface. When was this surface installed, what did
it replace, why was it installed, what cost was incurred installing
it and so on.

Please find attached the printouts of all footway works carried out on Kings Road since SAP started in 2004. There are two separate lists attached. One is works noted and carried out from our scheduled safety inspections and the other is of works carried out as a result of complaints or of defects noted in passing by any of our officers outside of the scheduled inspection regime.
The Inspection one states a location in the visible text on the printout but the complaint one doesn't. My colleague Peter Barton has therefore gone into each of them and added in an extra column at the end showing where each job is located. He cannot see any works which refer to either 421 or 423 (the tree is located between the two).
We cannot provide any records before 2004 as we no longer have the facility to go back into the old HIMS/WIMS system that existed pre 2004. However, Peter has confirmed that it has been accepted policy for many years now to remove and replace flags around trees with a flexible Bitmac surface where flags have started to become dislodged by tree roots. This is due to flags being affected by tree roots by causing them to lift and become dangerous trip hazards for pedestrians.

chase this matter up before receiving an answer, which is not
acceptable given the duty placed upon the council by law.

Dear Mr Finnigan
I refer to your email below, in which you request a review of the handling of your FOI request. I have undertaken the review, and I can report as follows.
Your request was received on 9 November 2011, and responded to on 9 December, this was the 22nd day following the date of receipt. Thus the Council did not comply with section 10(1) of the Act, which states that responses should be sent no later than the 20th working day following receipt.
I have discussed this issue with the officers involved, particularly the FOI coordinator responsible for this service area. It is clear that the delay was due to two factors, firstly a significant volume of work in the section at that time, and secondly a staff reorganisation which was being undertaken at the same time, which has resulted in a number of staff moving to different roles. I am satisfied that the staff were aware of the deadlines imposed under FOI, but on this occasion they were unable to meet them.
Whilst I have been provided with reasons as to why this response was delayed, this does not detract from the fact that we have failed to comply with the Act on this occasion, and I can only add my apologies to those of Mr Devine for the inconvenience this may have caused you. I can assure you that the Council is continually striving to improve its performance in these areas.
