Would it be better to ask how many certified offences they have come across during there investigations, and what was the outcome each time.

Until the LGO certify an offence it's not by definition a certified offence.

One could ask how many certifiable offences they came across but decided not to certify to the high court but that's not the information I want.

The LGO are trying to avoid answering this valid Freedom of Information Request even though the position, regarding a request that I withdrew with the same title, has been made clear to them.

On two occasions I have explained to the LGO that I withdrew an earlier FOI request of a similar name because of a glitch. The WDTK website were made of the problem with the website and marked the other request as withdrawn. Unfortunately the LGO insist on responding to the request I clearly withdrew whilst refusing to respond to this one which I haven't.

MESSAGE FOR THE LGO. PLEASE RESPOND TO THIS FOI REQUEST AND STOP RESPONDING TO THE ONE I WITHDREW.

To further clarify the situation all FOI requests have a unique URL so it is not that difficult for an authority to identify an individual request, keep track of it and respond to it rather than other requests from the same requester.

Dear Sir or Madam,

A third and final attempt to get you to respond to this FOI request
before I submit a complaint to the Information Commissioner.

I submitted a Freedom of Information request on the 18th September
2009.

[Over the last five years how many certified offences has each LGO
brought to the attention of the High Court, how many involved a
council member or officer, what were the outcomes and which council
did the member or officers work for.]

This was submitted via the What Do They Know website and has a

Unfortunately for some reason your office insists on responding to
a different Freedom of Information request. One which I had
withdrawn which has also has a unique URL and reply address.

Even when I submitted an internal review request regarding

You wrongly replied to the withdrawn FOI request. Just what do I
have to do to get you to respond to a valid FOI request and ignore
one that was clearly withdrawn?

I have no intention of following the suggestion in your response to
my withdrawn FOI request by submitting a third request.

I have submitted a valid Freedom of Information request via the
What Do They Know website and I demand a response.

The LGO always get 'confused' over things they would rather not respond to.

They do it with complainant's letters, by adding confusion when none really exists they can wind up a complainant until they snap which gives them a valid reason for not responding at all.

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Local Government
Ombudsmen's handling of my FOI request 'Certified offences to the
High Court?'.

Your reliance on the 1974 LG Act part III section 32 not to supply
the information is perverse because I am not asking the Ombudsman
to disclose any information obtained in the course of, or for the
purposes of, the investigation of a complaint. Far from it, I
merely wish to know how many times each Ombudsman had so much
difficulty obtaining information, for the purposes of an
investigation, they had to certify an offence to the high court.

Neither do I accept that the only way to obtain the information I
seek would be to examine each complaint file. Certifying an offence
to the high court is not something an Ombudsman would do lightly or
without recourse to legal advice, whether internal or external. As
such each Ombudsman or their legal advisors would have the
information at hand. I would also argue that a Local Government
Ombudsman certifying an offence to the high court is so rare it
would be easy for identify the few times it has been done, if at
all.

Please supply the information requested without any more perverse
excuses.

I believe that the is a way of finding this info from there records without beaching the DPA by running a search against there database records and asking for the results as a FOI request.

Internal reviews should be quick. If one takes longer than 20 working days then the authority should write and let you know, and it should never take longer than 40 working days.

Internal review was requested by Mr Nunn on the 18th of October, acknowledgement received 1st December, 32 days later and only after being prompted. 12 days longer than ICO requirements. This is not good enough from a public authority.

Actually the first time I asked for an internal review was way back in September. The 21st of September to be precise. That is 51 days before I received the acknowledgement to my second request for an internal review. To date I have been waiting 54 days for an internal review.

exceptional circumstances were that stopped you from completing the

The LGO have been giving me the run around for nearly three months instead of just giving me the information requested when first requested. I appreciate they don't want to give me the information because it could discredit their organisation but that is not a valid reason for failing to supply the information as MPs found out when they tried to block their expenses from becoming public knowledge.
