Dear Sir or Madam,
On August 12 2009, Andrew Daly answered an FOI request made by Mr
Jones (FOI/4176) and made the statement "Due to the specific nature
of their work, i.e. enforcement of parking, the CEOs have special
dispensation to park in all zones and in locations where other
vehicles would be deemed to be in contravention."
On August 14th 2009, Andrew Daly answered an FOI request made by
Charlie Lort-Philips (FOI/4224) and made the statement "CEOs use
mopeds whilst carrying out their enforcement duties and payment has
already been made by an annual permit for each moped."
The definition for dispensation is "the relaxation of a law in
particular circumstances; the act of an authority making an
exception to laws, standards, or customs" which i would assume
means that CEO's can park for free.
Please clarify if CEO's can park scooter's in motorcycle parking
bays for free, or if they have paid for permits. If they have paid
for permits, please provide proof of payments by receipts.
Please also clarify what training, if any, Andrew Daly has received
in order to answer these FOI requests as he seems to give a
different answer for the same question.

Dear Catherine Preston,
I'm afraid that your answers are still contradictory and you
haven't provided proof of parking permits as originally asked.
Please provide proof of purchase of parking permits for all 15
scooters used by CEO's.
Please also answer the original question which was "Do CEO's have
special dispensation or do they have permits to park in Motorcycle
Parking bays?".
As you may or may not know, it is against the law in the UK for a
vehicle to not display a valid tax disc.
I would also like to ask why scooters used by CEO's do not display
valid tax disc's?

Dear Customer Relations,
Thank you A Daly. It is illegal for a vehicle parked on the road to
not display a valid tax disc and i have now reported all
registration marks of scooters used by Westminster CEO's to the
local police.
Now please answer the original FOI request which was "Please
provide proof of purchase of parking permits for all 15
scooters used by CEO's.
Please also answer the original question which was "Do CEO's have
special dispensation or do they have permits to park in Motorcycle
Parking bays?"."
This question was originally requested on the 14th August, so to
comply with FOI law you MUST answer this request by 14th September
as i will not hesitate to send this to the ICO.

Thank you for your further e-mail on the subject. In response to your
statement today, 27 August 2009, you should refer to previous responses
to you regarding the above. Whilst understanding your feelings on this
matter, you have been supplied with full responses, clearly informing
you that NSL mopeds have valid annual permits and valid tax discs. Your
stated intentions in this regard are also acknowledged; however, your
latest e-mail, today, will not be treated as a Freedom of Information
request.

Unfortunately, you have yet to answer the original question which
was, once again, "Please
provide proof of purchase of parking permits for all 15 scooters
used by CEO's.
Please also answer the original question which was "Do CEO's have

Parking bays?"."
You have told me that all NSL mopeds have valid parking permits and
that they have special dispensation to park. It can't be both. I
don't understand why Westminster City Council would buy permits for
them if they have special dispensation to park in bays as this
seems a waste of the tax payers money. You have also yet to provide
proof of paid permits for NSL's mopeds.
So, i find myself asking again..
Please
provide proof of purchase of parking permits for all mopeds
used by Westminster City Councils CEO's.

CHARLIE LORT-PHILLIPS left an annotation (28 August 2009)
If they were stolen (the tax discs) then why when I also reported them to the police did they then arrive in Golden Square at lunchtime and take the tax discs out of their perforated papers and hurriedly attach them to the bikes?
I have a video of this I will send to various sites asap...
