Dear Sir or Madam,
Despite previous assurances that CEO scooters would not be parked
in public bays, Golden Square today had 9 WCC CEO scooters parked
on the corner opposite Beak Street.
1. Why are CEO scooters still parked in public bays?
2. Nine scooters were in the single corner motorcycle only bay, how
many motorcycles in total are earmarked for that bay?
3. Are CEO scooters exempt from displaying current road fund
licenses?
4. How big is the total fleet of Westminster Council CEO scooters?
5. When these parking services are provided to WCC, how is the
service, repair, road fund license, fuelling, insurance calculated
and how much do they cost for the fleet?

Dear FOI People,
Thanks for your responses. Just for clarity, the original document
sent on the 16th of September only contained my questions, as
outlined above.
This has led to an interesting development because I now have three
responses, each different though the content is similar with
exception to the answer for question 5.
In the "FOI Request 4253 Mr Sawyer ABD.doc" version question 5 is
refused (Section 17) under Part II, Section 43 (2) of the Act.
However in the earlier version question 5 is refused under Part II,
Section 42 (1) of the Act.
Section 42 covers Legal Professional Privilege, are you saying that
the question is refused because NSL Services Group has protection
in Law?
If that is the case you need to supply a two stage public interest
test, the first stage declaring why NSL would be protected from
disclosure. The second stage determining the true public disclosure
test.
In the previous response you cite a refusal under (Section 17)
under Part II, Section 43 (2) of the Act. This indicates commercial
prejudice.
If that is the case, could you please inform us how long the
contract has been in place with NSL Services Group and how long is
left to run on the contract?
It is my intention to contest your Section 43 refusal with the ICO
because the contract is already in place and commercial prejudice
must (surely) decrease as the contract is in progress unless sit is
specifically for a short period and re-tender is due imminently.
One further note. Despite three different responses to this one
request, each response is different and yet all responses share the
same date, the same reference and same named person dealing. Could
you please identify the favoured response?

Thank you for your email below, and my apology for the delay in responding
to it.
I apologise for the confusion caused.
The response sent out on the 24th September 2009 is our final response to
the original request.
You are correct in your assertion that there was an amendment between this
and the former versions.
Prior to sending this final response on the 24th September it was noticed
that an incorrect exemption had been cited and the decision was made to
amend this and not inform you of the change because, in accordance with
your email, it was believed that you had not received any other versions
of the response. It was considered to be less confusing to send one
correct response, than send multiple versions.
I note in your email below you have asked a question which is additional
to those in your original request. I have therefore logged this as a new
request, and you will receive an acknowledgement under a separate cover.

The latest answer given by the Council is not accurate, as NSL SERVICES GROUP LIMITED (06181220) was not incorporated until March 2007.
In April 2003 Westminster City Council say they awarded the Enforcement and Clamping contract for parking enforcement to National Car Parks Limited.
