The total staff/ consultant costs related to the Centre during the time
period specified amounted to £ 60,084.86. This figure is made up of the
salary costs detailed in the accounts above (incurred during and after
November 2009). The payments were made to:

-the University of Northampton for the contribution of a research fellow

-a research assistant

-a web developer

-Director of the Centre for New Zealand Studies

Detailed information on the identity of staff/ consultants is personal
information and hence protected from disclosure by Section 40 of the
Freedom of Information Act.

Thank you for your reply on May 20th to my FOI request submitted on
April 18th.

I have rated this on What Do They Know as “I've received some of
the information”.

I seek the missing information as a matter of urgency because the
20 day window for Birkbeck’s reply has expired.

I refer to item 4 of my request.

4) What staff / consultant costs has the Centre for New Zealand
Studies (or what remains of it) incurred between November 2009 and
31 March 2011? Who are these members of staff / consultants and
what types of work have been undertaken by them in this period?
If not shown in the above accounts, details of staff / consultant
costs.

While Birkbeck has provided job titles, it has not provided any
details of the “types of work, undertaken” by staff or consultants
in the period specified.

What has been achieved at a cost of over £60,000? For example, what
exists in the way of minuted meetings, reports, teaching,
publications, ongoing research, conferences hosted, exhibitions
held, visiting speakers, lectures to Birkbeck students or wider
audiences and contributions to continuing education?

Please provide names and dates of minuted meetings, reports,
publications, topics researched, lectures given etc.

Dear Julia Lerch / Katharine Bock,

Thank you for your reply today to my request for a complete reply
made on 23 May.

I ask Birkbeck for an urgent review the reply just made. If I am
not satisfied with the review or if no information is received by
the end of this week, I intend to make a complaint to the
Information Commission.

The grounds for my complaint are that I requested on April 18
information about what types of work have been carried out by staff
/ consultants for what remains of the Centre for New Zealand
Studies.

When Birkbeck replied on 23 May this information was missing. I
immediately advised it was missing and to assist Birkbeck, who
appeared to have difficulty with this part of my request, I
provided examples of how it might be met. I did not insist that all
of the examples were provided.

I look forward to your prompt response.

Data as exempted by the following sections of the Freedom of Information Act has been redacted:
** Section 40 Personal Data
** Section 43 Commercial Interests
** Section 27 International Relations

In your request you ask: "what has been achieved at a cost of over £60,000?". Please note that £53,334.31 of the £60,084.86 staff/consultant costs relating to the Centre during November 2009-31 March 2011 represented salary commitments to existing staff at the Centre as it was wound down in its existing form. This amount of £53,334.31 is made up of the following salary costs which were detailed in our release to your previous request:

** Salary costs (professional and support staff - web developer): £ 1,677.95
** Salary costs (academic - Centre Director): £ 27,838.66
** Salary costs (academic - research assistant): £ 23,818.00

The information attached to this email relates to what has been achieved for the Centre going forward, from the funding granted by the New Zealand Ministry of Education, at a cost of £12,631.25.

Dear Julia Lerch,

Thank you for your message posted on 20 June and the accompanying
attachments.

I seek an internal review of Birkbeck's latest response to my FOI
request 'Centre for New Zealand Studies - Finances, Rooms & Staff'.

Having studied the two sets of minutes provided (NZ Studies Network
- Meeting of a Group of Advisors 3.12.10 & Inaugural Meeting NZ
Studies Network 18.3.11), I am struck by the number of redactions,
including whole paragraphs that have been blacked out.

These raise the possibility of another complaint to the Information
Commissioner. Before doing so, I ask that Birkbeck review the reply
in general and the specific points raised below.

1. Many of the redactions are so short that they suggest initials,
presumably of people attending the meeting. If this is the case,
given that the attendees are identified under Present (and possibly
Apologies) on the first pages, how can Section 40 Personal Data be
used to justify the suppression of this information?

2. Information Commission guidance distinguishes between Commercial
Interests and Financial Interests. Given this, is Birkbeck sure
that all redactions citing Section 43 Commercial Interests are
compliant with this guidance?

3. Where redactions are extensive, is Birkbeck sure that all
information suppressed needs to be suppressed?

Are there parts of paragraphs and sentences that are not exempted
for the reasons cited?

4. "Section 27 International Relations" is cited in three places.
The guidance issued by the Information Commissioner does not allow
for automatic exemption on these grounds.

I suggest it would be unreasonable to suppress any information that
is likely to be made available following a request to the New
Zealand government under that country’s Official Information Act.

And by being more forthcoming, Birkbeck would reduce the need for
such a request to its international partner.

5. On page 4 of the December minutes, there appears to be a
redacted list of professional organisations that might be
approached. If this is the case, it is hard to understand what
Commercial Interests are at stake.

The same issue arises at the bottom of page 5 when potential
speakers are listed but suppressed on grounds of Personal Data.

Having considered your requests up until the 31st May 2011 and the related responses I conclude that the decision to treat your email request of 23rd May as a new request was correct. This is because the paragraph:

“What has been achieved at a cost of over £60,000? For example , what exists in the way of minuted meetings, reports, teaching, publications, ongoing research, conferences hosted, exhibitions held, visiting speakers, lectures to Birkbeck students or wider audiences and contributions to continuing education?”

is sufficiently different from your original request

“What staff/consultant costs has the Centre for New Zealand Studies (or what remains of it) incurred between November 2009 and 31 March 2011? Who are the members of staff/consultants and what types of work have been undertaken by them in this period? If not shown in the above accounts, details of staff/consultant costs.”

to be considered a new request.

In my view the information provided to you as a result of your original request was appropriate to the request that you made. The job titles (i.e. research fellow, research assistant, web developer and Director of the Centre for New Zealand Studies) and the split of the staff costs according to type (i.e. academic or professional and support staff) provided the information included in your first request regarding the types of work undertaken. The identity of the individuals was not provided, for the reasons given.
