date and time . Under the Freedom of Information request 2000.

3.Could you please inform me of the location of all CCTV cameras in
whitley bay which are currently ACTIVE.

4.Could you give me a list of CCTV in Cullercoats.

I seek clarity on your request, dated 15th August 2009.

In the 'subject' line of your e mail you state 'CCTV operating Whitley Bay
seafront', but in your request you ask for 'CCTV in Whitley Bay.'

Can you clarify which of those areas you are requesting information about,
is it just the sea front area, or is it the town of Whitley Bay as a whole?

Once clarity is received we can then consider your request.

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your email dated 14 September 2009 in which you made a
request for access to certain information which may be held by Northumbria
Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

1. Could you let me know How many CCTV Cameras there are in Whitley
Bay.

2. Can I apply to view footage of CCTV in Whitley Bay on a certain
date and time. Under the Freedom of Information request 2000.

3. Could you please inform me of the location of all CCTV cameras
in Whitley Bay which are currently ACTIVE.

4. Could you give me a list of CCTV in Cullercoats.

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

1,3&4 No information held. Northumbria Police hold no information as to
the number or location of all such devices, nor whether or not they were
active. There can be any number of overt or covert cameras used by
business for security/surveillance purposes.

It is usually the responsibility of Local Authorities to manage
and oversee operation of CCTV systems. The administrator and data
controller in this instance would be North Tyneside Council.

Any further requests should be directed to them.

2. Requests to view CCTV footage under the Freedom of Information
Act would not be granted.

Such requests fall under the Data Protection Act where a fee
applies. The person requesting must complete the relevant application
form, and must be specific as to the time and location they wish to view.
Images will be manipulated to show only the person requesting to avoid
any collateral intrusion.

For the fee a search will be made and a 'still' image produced.
Additionally an option to view is available by prior appointment.

CCTV tapes are only retained for 28 days.

The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must
be strictly in accordance with the Copyright Designs and Patents Act 1988
(as amended) or such other applicable legislation. In particular, you
must not re-use this information for any commercial purpose.

How to complain

If you are unhappy with our decision or do not consider that we have
handled your request properly and we are unable to resolve this issue
informally, you are entitled to make a formal complaint to us under our
complaints procedure which is attached.

If you are still unhappy after we have investigated your complaint and
reported to you the outcome, you may complain directly to the Information
Commissioner***s Office and request that they investigate to ascertain
whether we have dealt with your request in accordance with the Act.
