Dear FoI,
Sorry, I did ammend it but you must have missed it. The date was
Wednesday March 2nd between 3pm and 10pm. The was damage done to a
motorcycle parked in Tankerton close during that time. The police
have been informed and I would appreciate it if you checked the
footage between the times specified on the date.

Dear FoI,
This is the 3rd time I've had to reply about clarification. I did
edit my origonal request and have been in contact with your office
with no luck. I will update now once again with full information.
A black motorcycle was pushed / knocked over causing damage to the
right hand side in Tankerton Close, Cosham between 3pm and 10:15pm
on Wednesday 2nd March 2011. The times are correct as a neighbour
picked the bike up no later than 22:15hrs. I havethat your office
review the CCTV cameras but as of yet I have been told there was
nothing untoward captured on the cameras. Although I have a witness
that will state he picked the bike up personally and I have
photographic evidence of damage caused.
The incident has been reported to the police and I can supply a
crime reference number if required.

Thank you for your enquiry however Mr Harding Corporate information Governance Officer, has already responded to you 14/03/11 regarding CCTV, the Legislation and Law relating to CCTV.
As follows:
Dear Mr Amess,
So far Portsmouth City Council has not logged your request for CCTV footage under Freedom of Information Legislation. We have tried to expedite through dealing direct with the department.
The cameras are installed for the purposes of managing and protecting the housing estate of Portsmouth City Council and are Notified to the Information Commissioners Officer under PCC's Data Protection Notification. This is because they are likely to record personal details of individuals who can be recognised by those details.
Regrettably, disclosure of camera footage does not cover damage to an individual's property and is unlikely to be disclosed unless this is requested by the police in the investigation of a crime.
In your case you have a crime number and your best recourse is to pursue it through the police who have a legal position where they can request CCTV footage for the detection of a crime.
The Information Governance Team has enquired of any relevant information from the CCTV team and the response has been provided it to you. The cameras operate on motion detection so if there was activity then the cameras would have picked it up.
I appreciate that this may not seem satisfactory to you but we are unable to provide you directly with any footage as to do so would cause PCC to breach the Data Protection Act, as the purpose we collect the images is for managing and detecting crime against PCC property.
However, please do call us or provide a phone number for us to call you to discuss further.

I have just checked the whatdotheyknow web site for your enquiry and surprised to see Mr Harding's e-mail sent yesterday did not reach you. Concerned I have checked our sent items this end and can confirm it was sent to your e-mail address for this web site. I have no idea why it did reach you though, so far we have had no problems sending correspondence to whatdotheyknow as we do receive regular FOI requests/enquiries from this web site.
