A Freedom of Information request to Test Valley Borough Council by David Ellis

Dear Sir or Madam,
Please provide the following information : 1) The date of
installation of each of the CCTV cameras controlled by the Borough.
2) The retention period for data recorded by each camera. 3) For
each year since its installation, the number of Subject Access
requests under the Data Protection Act 1998 received for data from
each camera. 4) For each year since its installation, the number of
times data from each camera has been passed to the Police. 5) For
each year since its installation, the number of times data from
each camera has been used as evidence in Court proceedings.

Dear freedomofinformation,
No "e-mail below" (your words) was received, and none is evinced in
the thread of this correspondence.
Nonetheless, as you should be aware, a postal address is NOT
required for FOI requests. To quote:
Section 8.1.b of the FOI Act asks for an "address for
correspondence", and the ICO guidance is that an email address is
sufficient.
The Ministry of Justice has guidance on this – "As well as hard
copy written correspondence, requests that are transmitted
electronically (for example, in emails) are acceptable ... If a
request is received by email and no postal address is given, the
email address should be treated as the return address."
The Information Commissioner's "Hints for Practitioners" say "Any
correspondence could include a request for information. If it is
written (this includes e-mail), legible, gives the name of the
applicant, an address for reply (which could be electronic), and
includes a description of the information required, then it will
fall within the scope of the legislation."
As has been requested, since the Council is already in breach of
the law by not responding to this FOI request within the statutory
time-limit of 20 working days, a substantive response is required
within 48 hours.

Thank you for your e-mail of 9th August. it has been passed to me as
the Council's Freedom of Information Officer.
The information you requested was not held by the Council in a format
that could be disclosed to you and a map was created that gave the
various locations. This was a hard copy, hence the e-mail sent to you
on 4th July by Mark Lambert of Technical Services requesting a postal
address. We did not receive an address to enable us to send the map to
you and therefore were unable to process your request. Had we received
an address we could have forwarded the map to you.
You will of course appreciate that the Council is not required to send
information in the format requested if it is unable to do so. We took
the view therefore that the time to comply with your request stopped
until we received an address.
However following a conversation with Mr Lambert I understand that his
service is now able to scan the map and you will therefore receive the
scanned version shortly.

Dear Ms. Tovey,
Thank you for your response. Unfortunately I think wires have been
getting crossed. I received a communication from Mr. Lambert today
regarding my original request for information on the locations of
the Borough Council's cameras and associated signs, to which I
responded today that I had already received the information back on
9th July 2008 from a Ms. Dodd.
The request with which the current correspondence concerns itself
was in fact made on the same day, 9th July, as Ms. Dodd's reply to
me regarding the earlier request, and is a follow-on to that one,
but it is a separate request and asks for a very different set of
information. I have already been asked to repeat its contents once
in this thread, but for the sake of completeness, here is the
request again :

I refer to your request for information dated 9th July and apologise for
the delay in replying. There is some confusion as to whether you have
had an earlier reply due to my colleagues being on leave.
I understand that Mr Lambert responded to an earlier Email requesting
information on our CCTV system. If you have already received
information on this request please let me know.
1) The date of installation of each of the CCTV cameras controlled by
the Borough.
Unfortunately the cameras were not all installed as part of one
contract. I am therefore liaising with the Legal Department to get the
information by checking back the installation contracts.
2) The retention period for data recorded by each camera.

each camera.
I am liaising with our community safety manager on this question and
hope to provide the information in the very near future
