Dear Sir or Madam,
Please provide the following information : 1) The location of each
camera controlled by the Council. 2) The location of all CCTV
warning signs posted by the Council. 3) The date of installation of
each of the CCTV cameras controlled by the Council. 4) The
retention period for data recorded by each camera. 5) For each year
since its installation, the number of Subject Access requests under
the Data Protection Act 1998 received for data from each camera. 6)
For each year since its installation, the number of times data from
each camera has been passed to the Police. 7) For each year since
its installation, the number of times data from each camera has
been used as evidence in Court proceedings.

I wish to aknowledge receipt of you request for information
I have asked the relevant officers of the council to commence enquiries
immediately to find all applicable information relating to your request
under the FOI Act and to supply any which is found to me.
Your request has to be processed within a maximum of 20 working days,
which means the Council must provide you with the information it has
(assuming no exemptions are claimed) by15August 2008. If it is possible to
provide you with the information within a shorter timescale then that will
be done.

Further to my acknowledgement of your request, I have now received some
information from the relevant officers of the Authority. I can confirm we
do not hold all of the information requested.
You asked:
1) The location of each camera controlled by the Council.
I can confirm that we do hold the information requested, however, we
believe this information is exempt under section 31 (a) and (b) (Law
enforcement) of the FOI Act which relates to information where disclosure
would, or is likely to, prejudice:
a) The prevention and detection of crime.
b) The apprehension and prosecution of offenders.
and Section 38 (a) and (b) (Health and Safety) of the FOI Act which
relates to information where disclosure would, or is likely to:
a) endanger the physical or mental health of any individual
b) endanger the safety of any individual.
These exemptions are qualified exemptions, which means the public interest
test has to be applied. This has been done and the attachment below shows
our deliberation. On balance it is felt that it is in the public interest
to withhold this information.
2) The location of all CCTV warning signs posted by the Council.
I can confirm that we do not hold a register of this information although
I can confirm that the Borough fully complies with the legal requirements
for CCTV signage.
3) The date of installation of each of the CCTV cameras controlled by the
Council.
I can confirm that we do not hold a register with this information.
4) The retention period for data recorded by each camera.

5) For each year since its installation, the number of Subject Access
requests under the Data Protection Act 1998 received for data from each
camera.
I can confirm that we do not hold this information.
6) For each year since its installation, the number of times data from
each camera has been passed to the Police.
I can confirm that we do not hold this information.
7) For each year since its installation, the number of times data from
each camera has been used as evidence in Court proceedings.
I can confirm that we do not hold this information.
In order to be helpful and to assist, the answers to questions 6 and 7 may
be held by Cleveland police. In order to collate information relating to
question 2 and 3 from individual manual records of CCTV installations,
would exceed the £450 (18 hour) appropriate limit set by the Freedom of
Information Act 2000, therefore this part of your request would be
refused.
I hope that this satisfies your request for information. If you are not
satisfied with how your request has been dealt with then you are free to
make a complaint either to the Council or to the Information Commissioner.
