Dear Islington Borough Council,
I note on your website that you charge £42 for an initial search of
CCTV cameras from individuals, rising to a total of £210 for a
search and release of 6 or more images.
My understanding from reading the guidance by the Information
Commissioner is that such requests should cost no more than £10.
Could you please therefore provide the following information:
a) under which legislation does Islington Borough Council deal with
requests for CCTV Footage submitted using your CCTV Request form
(i.e. are such requests treated primarly as requests under the Data
Protection Act or other access legislation?);
b) copies of any internal guidance discussing the justification for
such a charging policy including confirmation as to whether or not
legal advice on such a policy was sought. If so, please provide a
copy of the advice or a summary/digest if not;
c) a copy of your data protection policy and CCTV policy with
specific reference to payment and its justification
d) any details setting out how the charges outlined on your website
have been arrived at e.g. how is the £42 for a search of a single
camera derived
e) in the past 3 years, how many requests for CCTV footage have
been processed (by year) and how many requests paid each sum (£42,
£84, £150, £210)

Thank you for your Freedom of Information request dated 20 December 2012 regarding CCTV search charges.
You requested the following information:-
a) Under which legislation does Islington Borough Council deal with requests for CCTV Footage submitted using your CCTV Request form i.e. are such requests treated primarly as requests under the Data Protection Act or other access legislation?
Response:
All requests are dealt with in accordance with the Data Protection Act 1998. The DPA statutory charge for an Individual Subject Access Requests is £10. However, LB Islington charge £42 to cover the administration costs.
b) Copies of any internal guidance discussing the justification for such a charging policy including confirmation as to whether or not legal advice on such a policy was sought. If so, please provide a copy of the advice or a summary/digest if not.
Response:
The policy for charging an administration fee for producing CCTV images was introduced when the new public safety and parking enforcement CCTV facilities in LB Islington opened. Please see attached Fees and Charges Exec.pdf, which was ratified by the Executive Committee in October 2011. CCTV charges are on the last page
c) A copy of your data protection policy and CCTV policy with specific reference to payment and its justification.

Response:
The £42 cost covers:
- A CCTV Operator's time to locate and save into the evidence locker within the 30 days
- Use of the Digital Video Recorder
- Supply of the media for downloading the CCTV images
- Storage of records made of the application for the images
- Arranging a time for the operators to prepare the CCTV footage in accordance the Data protection rules ready for the individual to visit the premises to view the image(s) if requested
e) in the past 3 years, how many requests for CCTV footage have been processed (by year) and how many requests paid each sum (£42, £84, £150, £210)
