Dear Wirral Borough Council,
Request for info Under FOI
You allow a private company to use CCTV Cars for the purposes of
parking enforcement for example out side of schools.
Does the council hold copies of the INDIVIDUAL'S CCTV LICENCE who
operates the CCTV on the cars ?
Does the council verify that the individuals working for the
private company hold the relevant legal SIA Licence ?

Good Morning,
Thank you for your request below. Please see Council's response which
I hope you find of use to you.
Wirral Council contract NSL Services limited to undertake parking
enforcement including CCTV enforcement from an approved device (a mobile
vehicle).
NSL's Professional Standards team liaise closely with the SIA, who have
told them that a CCTV SIA licence is only required for general public
space surveillance. If officers are carrying out traffic enforcement
only (which is the case), then an SIA licence is not required.

Dear Corrin, Jane,
I have spoke with the SIA previously and also copied the
legislation here for you. They are feeding you incorrect
information a licence is required for :
A Public Space Surveillance (CCTV) licence is required when manned
guarding activities are carried out through the use of closed
circuit television equipment to:
1.monitor the activities of a member of the public in a public or
private place; or
2.identify a particular person.
This includes the use of CCTV in these cases to record images that
are viewed on non-CCTV equipment, but excludes the use of CCTV
solely to identify a trespasser or protect property.
A Public Space Surveillance (CCTV) licence is required only if your
services are supplied for the purposes of or in connection with any
contract to a consumer

There is a group in the south east who have been closely examining
the licensing and operation of mobile CCTV cars used for parking
and moving traffic offences. They are known as the No To Mob
http://www.notomob.co.uk and so perhaps you may wish to join their
forum to check on the requirements of not only SIA but also
certification by the VCA.
Can you Please reply to my email and not go off the subject - we
are the north west not the south east and this is to do with your
council using them not the south east or any other council using
them,
I have show you legislation that confirms that they are required
under the private security act to hold a CCTV licence, You are not
aware of them holding one,
What are your next actions ?

Good Afternoon,
Thank you for your email below, please see copies of email correspondence
also below and I hope you find the information of use.
Please note - The mobile enforcement officers are working for Wirral
Council under contract through NSL.
The enquiry by NSL to SIA on our behalf makes it clear they are a company
working for Wirral Council and the response from the SIA is unambiguous.
As the officers concerned are working for the Council, they are exempt.

"We carry out CCTV enforcement for Wirral Borough Council. Our CCTV is
mobile and is attached to a Toyota IQ. The CCTV is used for traffic
enforcement only and is only used to capture vehicle information. The
vehicle does not monitor any movements of the general public and is not
used for any security issues or to identify any person involved in parking
contraventions. Please could you confirm that parking enforcement officers
do not need a SIA licence to carry out their duties in such a vehicle?"

They say working for the council they are not working for you they
are working on behalf of it. I have called them today and they said
you do need a licence may I suggest you email them this to see the
reply
Wirral council contracts NSL Ltd, and is not part of the council
but works on behalf of them and are a private limited company and
none of it's employees are working for the council only on behalf I
am sure you will get a different answer

situation for you with regard to how Freedom of Information (FOI)
requests regime works.
The FOI legislation exists to allow for copies of recorded information
to be requested from public bodies by organisations or individuals.
You have made a request to us and we have complied, disclosing copies of
the recorded information we have, in relation to your enquiry. The
Council is now satisfied that your request has been completed as we have
no more recorded information to disclose to you.
Individuals may or may not agree with the content matter they are
provided with under FOI; but the crux is that requests made under FOI
are for copies of recorded information only, held by a public body.
The Council has no more recorded information with regard to SIA to
disclose to you and your request is now considered completed.
