CCTV and DPA

Dear Fife Constabulary,

I am writing to you under the FOI act to request information
concerning the CCTV systems in Lochgelly in connection with the DPA
specifically CCTV code of practice Section 9 - Responsibilities.

An extract from the guidance notes:

9.1 Letting people know

You must let people know that they are in an area where CCTV
surveillance is being carried out.

The most effective way of doing this is by using prominently placed
signs at the entrance to the CCTV zone and reinforcing this with
further signs inside the area. This message can also be backed up
with an audio announcement, where public announcements are already
used, such as in a station.

Clear and prominent signs are particularly important where the
cameras themselves are very discreet, or in locations where people
might not expect to be under surveillance. As a general rule, signs
should be more prominent and frequent where it would otherwise be
less obvious to people that they are on CCTV........

Signs should:

* be clearly visible and readable;
* contain details of the organisation operating the system, the
purpose for using CCTV and who to contact about the scheme (where
these things are not obvious to those being monitored); and
* be an appropriate size depending on context, for example,
whether they are viewed by pedestrians or car drivers.

Under the FOI act I would like to know the following:

1. Where is the signage located in the Lochgelly area informing the
public that they are either entering a CCTV monitored zone or are
currently being monitored by CCTV?

2. If there is no signage warning the general public of CCTV
operating in the area, will Fife Constabulary be responsible for
providing adequate signage, and when will signage be provided to
make them fully compliant with the DPA?

3. How many crimes were committed in Lochgelly in the last year?

4. How many crimes were solved in the Lochgelly area by the usage
of CCTV?

5. How many crimes were detected in the Lochgelly area by CCTV?

6. What is the cost of maintaining the CCTV system in the Lochgelly
area in the last financial year?

7. Who is the Data Controller for the CCTV systems in Fife and how
can the Data Controller be contacted?

Very happy with the response. A couple of questions were partially answered, however, the justification for these partial answers are legitimate, and the Police were in their right not to answer (details below)

"It is not possible to identify those crimes where CCTV played a part in their detection without reviewing each one. As this information is not readily accessible, easily identifiable or held in a retrievable format and the research required to look into this further would impact significantly on staff time and resources, Therefore, under the terms of the Freedom of Information (Scotland) Act 2002, Section 12 Excessive cost of compliance applies."

Overall, happy with the way my FOI request was handled.
