Thank you for your recent correspondence to the Health Professions Council
(HPC), in which you have requested details of any complaints against
health professionals received from an organisation named Citizens
Commission for Human Rights (UK) Ltd.

The Fitness to Practise department is responsible for dealing with all
complaints made about professionals registered with the HPC. The Fitness
to Practise department is unable to disclose any such information
regarding complaints made to the HPC as information about complainants is
held confidentially for the purpose of regulatory investigations.

Dear Health Professions Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of the Health
Professions Council's handling of my FOI request 'CCHR Complaints'.

My reason for requesting an internal review is:

I do not agree that this information is confidential. As CCHR is a
corporation and not an individual, DPA does not apply.

I wish to refer you to Information Tribunal case EA/2009/0063
(Thackeray v IC & GMC):
http://www.informationtribunal.gov.uk/DB...
in which the Tribunal found there was a legitimate interest of the
public (under DPA)in the release of information relating to CCHR.

Public Authority: Health Professions Council
Summary: The complainant requested information about whether the public authority had received complaints about health professionals from an organisation called Citizens Commission for Human Rights (UK) Ltd. The public authority withheld this under section 30(2)(a)(iii) and section 31(1)(g) but failed to cite this initially. Further, it did not explain to the complainant that it was neither confirming nor denying whether it held the requested information; however it did clarify this with the Commissioner subsequently. The Commissioner finds that the public authority was correct to neither confirm nor deny whether it held the requested information. However he also finds that the public authority breached its obligations under section 17 of the Act. This decision notice is currently under appeal to the Information Tribunal.
