CCC In Breach of the Human Rights Act through the censorship of facebook

James Marshall made this Freedom of Information request to Cornwall Council

The request was successful.

From: James Marshall

8 December 2008

Dear Sir or Madam,

The Website www.facebook.com is blocked by the webservers of
cornwall county council so is not available for access at any
public library.

Under the human rights act 1998, as a public authority you are duty
bound by law not to violate any article.

But by blocking this website as a public authority you are in
violation of:

Article 8
Right to respect for private and family life
1Everyone has the right to respect for his private and family life,
his home and his correspondence.

Article 9
Freedom of thought, conscience and religion
1Everyone has the right to freedom of thought, conscience and
religion; this right includes freedom to change his religion or
belief and freedom, either alone or in community with others and in
public or private, to manifest his religion or belief, in worship,
teaching, practice and observance.

Article 10
Freedom of expression
1Everyone has the right to freedom of expression. This right shall
include freedom to hold opinions and to receive and impart
information and ideas without interference by public authority and
regardless of frontiers. This Article shall not prevent States from
requiring the licensing of broadcasting, television or cinema
enterprises.

and finally

Article 10
Freedom of expression
1Everyone has the right to freedom of expression. This right shall
include freedom to hold opinions and to receive and impart
information and ideas without interference by public authority and
regardless of frontiers. This Article shall not prevent States from
requiring the licensing of broadcasting, television or cinema
enterprises.

Under the freedom of information act

My questions are as follows

A) Why is facebook still blocked

B) What is the evidence for this website being blocked

C) who made this decision

D) Why is it blocked considering no other local authority has it
blocked on their servers

E) Is it of the notice of the relevant people this breach?

Yours faithfully,

James Marshall
