Cautions issued for RIPA s1 Offences by Police Force

Dear Ministry of Justice,

In response to an earlier FoI request, you disclosed that four
people were cautioned in 2008, for offences under s1(1),(2),&(7) of
the Regulation of Investigatory Powers Act 2000 (Part I) (*).

Further, I note from MoJ answers to Parliamentary Questions, you
also hold statistical data about the cautions issued for particular
offences by specific Police forces (see example **).

Please could you list for me - by Police force - the total number
of cautions issued for offences under RIPA (Part I) s1(1),(2),&(7)
for the year 2008.

I am particularly interested in data for the Metropolitan Police,
City of London Police, and Thames Valley Police.

for cautions issued for RIPA s1 Offences by Police Force under the
Freedom of Information Act 2000 (FOIA) from the Ministry of Justice
(MoJ).

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest

Dear Ministry of Justice,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Ministry of Justice's
handling of my FOI request 'Cautions issued for RIPA s1 Offences by
Police Force'.

Please can I draw your attention to Home Office circular 016/2008?
(link below).

"In order to ensure accurate reporting of all simple cautions, it
is important that the correct data is sent to the Ministry of
Justice ... on a monthly basis".

That being the case, I believe you do hold the data I requested.

Perhaps as "CrimSec 3" forms, or as "NG form/upload", for the
purposes of Offences Brought to Justice (OBTJ)?

Please disclose to me, for each Police force area, the number of
cautions issued for offences under RIPA (Part I) s1(1),(2),&(7) for
the year 2008.

Thank you for your e-mail of 24 April in which you requested that we
carry out an internal review of our handling of your request for the names
of offenders cautioned under the Regulation of Investigatory Powers Act
2000 (RIPA) in 2008.

Your request has been passed to me to consider as I carry out reviews of
previous FoIA decisions on behalf of the department . I have now
completed my review and would like to begin by stating that I will be
upholding our previous decision that we do not hold the information you
requested for the following reasons.

In our response of 25 March we explained that the Ministry of Justice did
not hold this information as we only hold statistical data on the number
of people cautioned under RIPA, and advised that such information will be
held by individual police forces in England and Wales. We went on to
advise that since the police forces in England and Wales come within the
remit of the Home Office you may wish to contact them directly and
provided the attached link to their e-mail address:

I can confirm that individual police forces provide the Ministry of
Justice with statistical data on the number of people cautioned under RIPA
but this does not include the offender's name. I understand that we have
already provided you with the statistical data we hold on the number
of offenders cautioned under RIPA for 2008.

I am therefore satisfied we do not hold the names of offenders who were
cautioned under RIPA s.1(1) offences in 2008. I would advise that you
make a request to individual police forces in England and Wales for this
information.

I trust that this answers your query but if you are not satisfied with
this response you have a further right to ask the Information Commissioner

Dear Mr Perry,

thank you for your reply to my FoI request
(http://www.whatdotheyknow.com/request/ca...).

It seems you are protecting the criminals involved in those
offences at the expense of the victims.

If the MoJ will not indicate which police force issued cautions for
RIPA s1 offences in 2008, how are victims of those criminals
supposed to obtain documentary evidence of the cautions for the
purpose of seeking compensation?
