Dear Sir or Madam,
Ref 12012
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of UK Border Agency's
handling of my FOI request 'Cassidy, J'.
In your response you claim that you do not need to respond due to
the Data Protection Act. I wish to request an Internal Review of
this decision. This is because I do not consider the Data
Protection Act has been applied correctly in this case. All the
information requests by Cassidy J concern those made through the
open and transparent whatdotheyknow.com Freedom of Information
website, which is in the Public Domain. But I cannot see why the
UKBA has refused many of the Cassidy J information requests. As
each request can be viewed at whatdotheyknow.com this means that
any refusal that you have made does not raise any Data Protection
Act concerns.
Introduction to WhatDoTheyKnow
"I'd like to keep my request secret! (At least until I publish my
story) #
WhatDoTheyKnow is currently only designed for public requests. All
responses that we receive are automatically published on the
website for anyone to read. You should contact the public authority
directly if you would like to make a request in private.
Why will my name and my request appear publicly on the site? #
We publish your request on the Internet so that anybody can read it
and make use of the information that you have found.
Your name is tangled up with your request, so has to be published
as well. It is only fair, as we're going to publish the name of the
civil servant who writes the response to your request. Using your
real name also helps people get in touch with you to assist you
with your research or to campaign with you. "

"I once again confirm that I am happy for the whatdotheyknow.com
user Ben Ingram to receive any information you hold on me in
connection with any of my 2009 FOI requests made c/o
whatdotheyknow.com. I do not see any lawful reason why my Data
Protection Act should be used to frustrate FOI disclosures from
being made, as I would be happy for such data to be disclosed to
Ben Ingram or to anyone else, so long as it is sent c/o a
whatdotheyknow.com user."
