Cancelled PCNs

Dear Allerdale District Council,

I would like to know,

since the introduction of decriminalised parking:

1) how many PCNs have been cancelled in total

2) how many of 1) were cancelled after informal representations

3) how many of 1) were cancelled after formal representations

4) how many appeals have been to adjudication

5)how many PCNs have been cancelled following procedural
impropriety

6) how many PCNs were issued between may 2005 and august 2006

7) how many versions of PCN has there been since allerdale took
over parking enforcement

Dear Andrew,

I apologise for my late response on this issue but you requested
further clarification, which follows.

To answer 2) and 3) you could see how many we're cancelled
following adjudication, as in 4), and see how many official notices
of rejection have been issued, as in 3) which should leave the
answer to 2).

As for your point number 5, Parking services shoukd be familiar
with the fact that procedural impropriety is defined by The Civil
Enforcement of Parking Contraventions (England)
Representations and Appeals Regulations 2007,:

4(5) In these Regulations “procedural impropriety” means a failure
by the enforcement authority to observe any requirement imposed on
it by the 2004 Act, by the General Regulations or by these
Regulations in relation to the imposition or recovery of a penalty
charge or other sum and includes in particular—
(a)the taking of any step, whether or not involving the service of
any document, otherwise than— (i)in accordance with the conditions
subject to which; or
(ii)at the time or during the period when,
it is authorised or required by the General Regulations or these
Regulations to be taken;
