Dear Department for Environment, Food and Rural Affairs,

I refer to the supplementary consultation response -

and in particular the response to 'Freedom of Information and the
Environmental Information Regulations' (bottom of page 4).

Please provide the following information.

The total number of groups who responded to the supplementary
consultation.

The total number of individuals who responded to the consultation.

For each of the three options given -

The total number of groups who chose that option.

The total number of individuals who chose that option.

I note that the response states - 'The Government, therefore,
intends, subject to parliamentary approval, to apply the FOIA to
the CRT in respect of those functions and duties that will transfer
from BW to the CRT under the proposed Transfer Order. This limited
application of the FOIA will have the effect of excluding from the
provisions of the Act those broader charitable functions carried
out by the CRT (including, e.g., its own fundraising). It will also
exclude bodies that merge with the CRT, unless the FOIA already
applies to them at the point of merger.'

Can you please provide a copy of your proposed amendments to FOIA.

For the avoidance of doubt can you please also confirm that -

FOIA requests concerning public assets (e.g. non-operational
property portfolio, operational assets, other funds provided by
government)will not be excluded.

That, (in line with the assurance given by the Waterways Minister
to Duncan Hames, Liberal Democrat MP for Chippenham, on the 13th
October 2011) CART will be subject to FOIA on vesting day should
parliamentary approval to further exclusions not already embodied
in the Act be delayed or refused.
