Thank you again for your e-mails received by Transport for London (TfL) on
20 April 2011. You have asked for the disclosure of correspondence between
TfL and various other bodies regarding the Cable Car. Your requests are
being considered under the Environmental Information Regulations 2004
(EIRs).
Unfortunately because of the complexity of the requests and the variety of
departments and teams holding potentially relevant information, we will be
unable to resolve your requests within the initial statutory 20 working
day deadline.
To enable us to fully consider your requests, in accordance with
Regulation 7(1) of the EIRs we have had to extend the deadline for
providing a response to 40 working days from the date we received your
requests. The amended date for a final response is now 22 June 2011. We
are working to ensure that you receive a response before this date if
possible.
I apologise for the delay and any inconvenience this may cause you. If you
have any queries or would like to discuss your request, please feel free

Thank you for your email received by Transport for London (TfL) on 20
April 2011 asking for a copy of all correspondence between TfL and NATS on
15, 16, 17, and 18 March 2011 regarding the Cable Car.
Your request has been considered under the requirements of the
Environmental Information Regulations 2004 and I can confirm that TfL does
hold the information you require. You asked for:
A copy of all correspondence between TFL and NATS on 15TH , 16TH , 17TH ,
AND 18TH March 2011 regarding the Cable Car.
A copy of this is attached. Some of the information you have requested has
been redacted from the attached email exchange as TfL is not obliged to
supply it, because it is subject to a statutory exception to the right of
access to information, under Regulation 12(5)(e) of the EIRs - `the
confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest' and under Regulation 13 -`personal data'.
TfL is applying Regulation 12(5)(e) because disclosure of the financial
details which have been redacted would adversely affect TfL and NATS'
legitimate economic interests by revealing the daily rate which NATS
charged for providing the service described in the email exchange. This
would compromise their ability to compete for the provision for similar
services in the future and adversely affect TfL's ability to gain the best
possible value from suppliers of such services. This information is held
by TfL under a common law duty of confidence.
The use of this exception is subject to an assessment of the public
interest in relation to the disclosure of the information concerned. There
is a general public interest in the disclosure of information held by
public authorities, to promote transparency and accountability, but in
this instance this is outweighed by the public interest in preserving the
ability of NATS to compete effectively and, particularly, the ability to
ensure TfL gains the best possible value from suppliers of services.
Regulation 13 has been applied to redact the contact details of
individuals, as disclosure would contravene the first principle of the
Data Protection Act 1998, which requires all processing of personal data
to be `fair and lawful'. In this case disclosure would be `unfair' as the
individuals concerned have a legitimate expectation that their contact
details will not be made public.
