A Freedom of Information request to Ealing Borough Council by Vicky Gray

Currently overdue a response from Ealing Borough Council. By law, the response had to be prompt but no later than 7 January 2009.

Dear Sir/Madam

I would like to know how many employees of the city council have
been absent from work due to either stress, anxiety, depression or
any combination of those ailments between 1st August 2004 and 31st
October 2008.

Please also confirm how many complaints of bullying have been made
by employees of the council against managers or colleagues during
the same period.

Please confirm how many employees have claimed constructive
dismissal within the same period for bullying/harassment.

Please confirm how many claims have been filed against the city
council at the Employment Tribunal within the same period for
bullying/harassment.

I would ask that you remember the statutory duty imposed upon
public authorities by virtue of Section 16 of the Freedom of
Information Act to provide advice and assistance to requesters. If
for any reason you are leaning toward rejecting any part of this
request or if you plan to argue that it is unmanageable or
unanswerable in any way then I would expect you to contact me
promptly to find ways to answer this request to our mutual
satisfaction.

Dear Sir or Madam

I would also clarify when I mentioned constructive dismissal, I was
referring to the employee directly, similar point about bullying
and harassment complaints, there is no Employment Tribunal claim
called "bullying and harassment". This will usually form part of a
claim for unfair dismissal or one (or more) of the various
discrimination claim and/or under the Protection from Harassment
Act. Could you provide the information on the aforementioned.

Could you provide the information in electronic format via this
website.

FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Thank you for your request for information, which was received on 4 December. I have sent the following questions to the service area:

Between 1 August 2004 and 31 October 2008:

1. How many council employees have been absent from work due to either stress, anxiety, depression or any combination of these?
2. How many complaints of bullying have been made by employees of the council against managers or colleagues?
3. How many employees have claimed constructive dismissal for bullying or harassment?
4. How many claims have been filed against the council at the Employment Tribunal (i) for unfair dismissal involving bullying or harassment, (ii) for discrimination involving bullying or harassment, and (iii) under the Protection from Harassment Act?

If I have not understood your request correctly please let me know as soon as possible.

Your request is being considered and you will receive the information requested within the statutory timescale of 20 working days as defined by the Freedom of Information Act 2000, subject to the information not being exempt or containing a reference to a third party.

The Freedom of Information Act 2000 defines a number of exemptions that will prevent the release of information. We will assess the information you have requested to determine if any of the exemption categories apply. If an exemption applies some or all of the information you have requested may not be released.

If the information you request contains reference to a third party then they may be consulted prior to a decision being taken to release the information to you.

There may be a fee payable for this information. If this is the case you will be informed prior to any work commencing on your behalf. The 20 working day time limit for responses is suspended until receipt of the payment.
