Dear Sir/Madam
I would like to know how many employees of the city council have
been absent from work due to either stress, anxiety, depression or
any combination of those ailments between 1st August 2004 and 31st
October 2008.
Please also confirm how many complaints of bullying have been made
by employees of the council against managers or colleagues during
the same period.
Please confirm how many employees have claimed constructive
dismissal within the same period for bullying/harassment.
Please confirm how many claims have been filed against the city
council at the Employment Tribunal within the same period for
bullying/harassment.
I would ask that you remember the statutory duty imposed upon
public authorities by virtue of Section 16 of the Freedom of
Information Act to provide advice and assistance to requesters. If
for any reason you are leaning toward rejecting any part of this
request or if you plan to argue that it is unmanageable or
unanswerable in any way then I would expect you to contact me
promptly to find ways to answer this request to our mutual
satisfaction.

Dear Customer Care Centre
I would also clarify when I mentioned constructive dismissal, I was
referring to the employee directly, similar point about bullying
and harassment complaints, there is no Employment Tribunal claim
called "bullying and harassment". This will usually form part of a
claim for unfair dismissal or one (or more) of the various
discrimination claim and/or under the Protection from Harassment
Act. Could you provide the information on the aforementioned.
Could you provide the information in electronic format via this
website.

Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Glasgow Council's
handling of my FOI request 'Bullying and Harassment'.
A full history of my FOI request and all correspondence is

They have said some of the information is not held, but have not
confirmed what precisely is not held, unless it refers to their ‘no
information available’ entry in the table. They should make clear
what is not held and why no information is available. Do they not
record bullying complaints?
The statement about a central database is not the point at issue.
They do have the information and claim it would be too expensive. I
would ask for a breakdown of how the cost has been calculated.
On the basis of the foregoing, I would ask that a review be carried
out and that I be advised of the outcome of that review within the
timescales deemed appropriate in the Information Commissioner’s
recent guidance.

I am responding on behalf the member of my team who has been
dealing with this matter on behalf of the City Council.
Further to your previous correspondence with the council, as a
goodwill gesture we are now uploading the absence data onto the
Whatdotheyknow website.
The web submission form does not appear to permit uploading the
tabulated figures emailed to you on 26 May 2009, so we have instead
had to upload the Excel spreadsheet. You may be able to open this
with a web browser.
In terms of the figures themselves, please note that the Council
are unable to provide exact numbers of absences as per your
question 1, as the Council does not record this kind of information
in a manner that would comply with your request, as has been
determined throughout the appeal process with the Commissioner. The
psychological absence data contained in Table 2 below also contains
other types of absence data, differing than those forming your
request that cannot be removed and therefore, the data within Table
2 will be skewed when considered in the context of your question,
as previously explained. It is the Council's understanding that the
information provided also contained information extraneous to your
request that could not be extracted further, but that you were
desirous to receive it anyway so that you could make your own
determination. I therefore copy and paste the information as
previously sent to you here for ease of reference. Service No of

I am mindful that Glasgow Council have cited the ‘costs’ exemption, yet section 15 of FOISA imposes a duty to provide advice and assistance. Yet Glasgow Council have not done so. Glasgow Council have done nothing to assist me in seeking to find a way that would help me obtain the information I am requesting. Therefore, if the information exists, Glasgow Council are required to disclose it unless an exemption applies. I am mindful that Glasgow Council have cited the ‘costs’ exemption, yet section 15 of FOISA imposes a duty to provide advice and assistance. Glasgow Council have not done so. Glasgow Council have done nothing to assist me in seeking to find a way that would help me obtain the information I am requesting.
Therefore the only conclusion I can draw is that Glasgow Council are purposefully seeking to conceal the number of cases of bullying
within their organisation.
