Dear Department for Business, Innovation and Skills,
Could you please send me a copy of response you sent in relation to
the FOI request you assigned reference number 11/0033.
The request was for information relating to an "opinion survey"
carried out as part of the Browne review into higher education
funding.
Please send the full response, including the content of the
covering letter, results of the survey (including appendices to the
results document), and copies of materials used when talking with
the survey participants.
As I am requesting a copy of an FOI release you have already made,
and the FOI Act requires you respond to requests "promptly" I am
expecting a the information "by return".
I note I am having to make this request because the department has
not been keeping its FOI disclosure log up to date.

Dear Mr Taylor,
Thank you for your email received on 10th March 2011 in which you
requested under the Freedom of Information Act a copy of the response to
the FoI request 11/0033.
You have requested:
Could you please send me a copy of response you sent in relation to the
FOI request you assigned reference number 11/0033. The request was for
information relating to an "opinion survey" carried out as part of the
Browne review into higher education funding.
Please send the full response, including the content of the covering
letter, results of the survey (including appendices to the results
document), and copies of materials used when talking with the survey
participants.
Please find attached the full response which was sent in the body of an
email. We have redacted the original requester's personal information
under section 40 of the FoI act. Section 40 provides an absolute exemption
for personal data which then falls to be dealt with under the Data
Protection Act. Personal data of third parties can only be disclosed in
accordance with the data protection principles. In particular, the first
data protection principle requires that disclosure must be fair and lawful
and must comply with one of the conditions in Schedule 2 of the Data
Protection Act. We do not think that it is fair to release the name and
email address of the requester and do not think that any of the relevant
conditions apply.
If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to me.
Please remember to quote the reference number above in any future
communications.
If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
