Dear Foreign and Commonwealth Office,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Foreign and
Commonwealth Office's handling of my FOI request 'British Iranian
Chamber of Commerce'.

1. The redactions made under Section 40(2) and 3 FOIA -
I refer you to the case of Durant V Financial
Services Authority in which the Court concluded that
personal data is information that affects a person
privacy whether in his personal,family life,
business or professional capacity. so identification
alone no longer guarantees that data is personal. I
also refer you to the Freedom of Information
Awareness Guidance No1 Personal Information issued
by the ICO

2. Information withheld under Section 41 (1) (b)
(Disclosure of Information would Constitute a
Beach of Confidence actionable by that or any
other person)- how would such disclosure would
be a legal breach of confidence and how would
disclosure would actually harm the commercial
interest of the name person?

3. Information withheld under Section 43(2)
how would disclosure would actually harm the
commercial interest of the name person/company
named?
The balancing test does need to take into account
any harm that may be caused to a private firm by
disclosure. That is private interest rather than
a public interest and so should not be taken into
account.

4. Information withheld under Section 44-(1) (b)
Prohibitions on disclosure - which Act/
regulation apply to your non disclosure of
information?
