British government involvement in Youtube censorship

John Walker made this Freedom of Information request to Home Office

The request was partially successful.

From: John Walker

2 March 2009

Dear Sir or Madam,

A friend of mine recently received the following email from
Youtube:

"The following video(s) from your account have been studied after a
complaint by a third party acting on behalf of the British
government. The inspection has been by the YouTube team under our
Community Guidelines:

* zzzzzzzzzzzzzzzzzzzzz

Your account has now received one Community Guidelines warning
strike, and you are suspended for a period of three Months from
uploading any new material onto the channel itself. Additional
violations will result in the disabling of your ability to post
coments to YouTube and the termination of your account forthwith.

It may interest you to note that after consultations with the
British authorities your own channel has now been branded "highly
distasteful", and therefore it will not now be possible to send
your videos to "Friends"."

Please supply:

1. a copy of the policy documents relating to government meddling
with Youtube content and your legal justification for interfering
with free speech;

2. the name of the government department that Youtube consults with
regarding these and other "distasteful" videos;

3. the name of the "third party acting on behalf of the British
government".

Yours faithfully,

John Walker

"I disapprove of what you say, but I will defend to the death your right to say it." - Evelyn Beatrice Hall summarising Voltaire

If this is true, the explanation for the UK Government curtailing freedom of speech had better be rock solid. I'd be very interested to learn what the justification is, and what the policy that applies might be.

Dear Oliver Paulette (IMS),

I request an internal review into this FOI because I feel that you
could try a little bit harder to answer the questions.

In your reply, you state: "officials have had general conversations
in the past with Google about Youtube content".

In light of this, please clarify my original questions as follows:

1. [original question] a copy of the policy documents relating to
government meddling with Youtube content and your legal
justification for interfering with free speech;[/original question]

Upon which of your department's policies were these "conversations"
made? Presumably these "conversations" were based on some
guidelines.

Have you had "conversations" with other website owners about their
content of their sites? Which websites? Is there a written record
of these conversations? If so, please supply.

2. [original question]the name of the government department that
Youtube consults with regarding these and other "distasteful"
videos;[/original question]

Please supply the name, rank/grade and job title of the person in
your department who handles these matters.

3. [original question]the name of the "third party acting on behalf
of the British government".[/original question]

I'm sure you could easily find out the identity of the "third
party". Perhaps the person in your department who liaises with
Youtube could ask them.

Yours sincerely,

John Walker

Perhaps the question of who deals with such matters could be better directed at Youtube directly? Presumably they also have this information.
