8. How many Police Protection Orders were made in each year?
In accordance with section 1(1) (b) of the Act our response is provided
below;
As both your requests relate to the same subject matter your requests have
been amalgamated in line with Section 12 (4) (a) of the Freedom of
Information Act 2000. From our preliminary assessment, we estimate that
compliance with your request would exceed the appropriate costs limit
under section 12 of the Freedom of information Act 2000. This is currently
*450. The reasons for this are there are 8,946 incidents with the
qualifying code for "Vulnerable child or young person involved". To
obtain the level of detail requested (i.e. who reported the incident, if
the child involved was a family member etc.) would mean reading through
each incident. This it is estimated would exceed the appropriate limit.
The appropriate limit is defined in the Data Protection and Freedom of
Information (Fees and Appropriate Limit) Regulations 2004, which is
covered by statutory Instrument Number 3244 of 2004. Furthermore, Section
12 of the Freedom of Information Act 2000 allows a public authority to
refuse to respond to a request for information where the cost of
compliance would exceed the appropriate limit as defined by the above
mentioned regulations.
We can say that if you would care to re define your request we could
probably provide information in respect of how many charges there were,
whether the person was male/female, we could also provide the number of
incidents by grade (although we would require clarification of which
incident codes to use as below) within the FOI time/cost constraints.
If you wish to proceed with the above re definition could you please
advise if the suggested qualifying code would meet your requirements as
follows: "Vulnerable child or young person involved". This qualifier is
to be used to endorse any incident where the involvement of a child or
juvenile (aged 17 or under) has been a significant factor and where there
has been some risk to that child/juvenile and/or the age has been an
important factor. This qualifier should also be used for incidents
involving child protection concerns.
Please note: that when a child is removed under police protection powers
(where a reasonable cause to believe a child would otherwise be likely to
suffer significant harm) it is not an order granted by a court, so
therefore should not be referred to as a 'police protection order'.
Police protection is an emergency power and should only be used when
necessary, the principle being that wherever possible the decision to
remove a child/children from a parent or carer should be made by a court.
However, there may be circumstances where there is not enough time to
seek an emergency protection order.
Emergency Protection Orders are issued by a magistrate, and can be applied
for by Social Services or anyone like the police or a neighbour. Even if
the Police have applied for the EPO responsibility for care remains with
Social Services. Therefore information on EPO's will be held by the Local
Authority for the purposes of providing care and forms part of the
children's record.
