Classification: NOT PROTECTIVELY MARKED

Thank you for your enquiry which has been logged under the above
reference. Having completed my enquiries I am able to respond as follows:

For the years 2008, 2009 and 2010 please could you provide a year by year
break down of all Charges there have been under the following Acts:

1. Children and Young Persons Act 1933 sect 1
2. Infanticide Act 1938
3. Indecency with Children Act 1960
4. Sexual Offences Act 2003
5. Protection of Children Act 1978 Sect 1
6. Child Abduction Act 1984
7. Domestic Violence Crime and Victims Act 2004 sect 5
11. Mental capacity Act 2005 sect 44

Please could you also state whether the person charged was male or female.

I have attached a chart showing as much information as we have been able
to retrieve. The indecency with Children Act was repealed in 2004 so there
is nothing under that heading.

Comments from the Crime Statistics Officer who produced the figures are as
follows and may be of use:

This shows the number of individuals (rather than crimes) detected by way
of a charge in each of the requested years for the offence types
requested.

I've managed to pick out the specific laws for most of this apart from the
Sexual Offences Act 2003. For a couple of the laws there were no charges
recorded in any of these years so I've not included them.

The part labelled sexual offences is just every offence that falls within
the sexual offences section of the counting rules. Up until 2008 / 2009
Police forces were still recording historic offences under old legislation
even though they may well have been dealt with under the 2003 legislation
and from the offence names it's not always clear if it's under the old or
new laws being used. Judging by the title of this FOI the requestor may be
mostly interested in the offence types involving child victims so they
should probably be aware that the sexual offences act is a large piece of
legislation and not specifically for offences in which children are the
victims. I've included everything but I'm sure they can sort through and
find the offences they want to know about.

I hope the information provided is of use.
