Dear UK Border Agency,
I am writing to make an open government request for all the
information to which I am entitled under the Freedom of Information
Act 2000.
Could you please provide me with the following information.
1. What actions were undergone on the bogus colleges found guilty
of breaking the immigration rules during the last 3years? How many
of them were convicted and what are the convictions in detail?
I am aware that I am entitled to a reply within 20 days otherwise
you are breaking the law. But your reply at the earliest will be
most appreciated.
Thank you.
Yours faithfully,
Debbie Gibson

Dear Ms Gibson
Thank you for your enquiry of 15 December. This falls to be dealt with under the Freedom of Information Act (FOIA) 2000.
I am currently unclear about the exact scope of the information in which you are interested. To ensure that we provide you with the right information, please could you clarify your request, so that we can process your request. Section 1(3) of the Freedom of Information Act provides that a public authority need not comply with a request for information unless any further information reasonably required to identify and locate the information is supplied.
You requested the following information:
1. What actions were undergone on the bogus colleges found guilty
of breaking the immigration rules during the last 3 years? How many
of them were convicted and what are the convictions in detail?
I am currently unclear about the term "bogus colleges" and the type of convictions you are referring to. There are a variety of reasons why we revoke a sponsor license and the type of actions we undertake will depend on the circumstances which will differ with each sponsor.
To obtain information on all sponsors whose sponsor licence was revoked over the last 3 years would exceed the £600 cost limit under the FOIA and we would therefore not be able to comply. In addition, we would not be able to provide details of any specific criminal actions we undertook if requested under the FOIA as this would fall under section 31 (law enforcement) of the Act.
Please see our website links below for more information on compliance including the Tier 4 Sponsor Guidance which provides an outline of the actions we undertake if a sponsor does not comply.

Can you please refine your request so that we can consider your request within the cost limit.
When you provide this information we will aim to send you a full response to your request within twenty working days of its receipt. I look forward to hearing from you shortly. However, please note that if I do not receive appropriate clarification of your request within three months from the date of this letter, I will consider this request to be closed.
Kind Regards
