I refer to the board meeting held on 19/5/2011.

Can you please provide via whatdotheyknow.com a copy of all
reports, sub committee minutes and other documents entioned in the
minutes of this meeting.

Can you also provide a copy of the minutes and agenda, unless these
have already been published on your website.

May I ask that you give full reasons (quoting the relevant section
of the FoI Act) for any redacted information.

Bearing in mind your breeches of the freedom of information act in
respect of a similar requests, may I remind you of your legal
duties in respect of this request.

Information has been redacted from the Property report May 2011, Marketing Report May 11 and Finance Board report May 11 as it is exempt from disclosure under the provisions of section 43 (Commercial Sensitivity) of the Freedom of Information Act 2000 as disclosure would be prejudicial to the commercial interests of BW and third parties. Furthermore, the public interest in maintaining that exemption outweighs the public interest in disclosing the information.

If we haven’t reasonably met your expectations in relation to a request for information or you believe we may not have acted in accordance with the above legislation you should write in the first instance to Kelly Radley Head of Customer Relations, 64 Clarendon Road, Watford, Herts WD17 1DA outlining your concerns and asking for a review to be undertaken. Further to my earlier e-mail please find attached a copy of the Scotland Board report for May 2011 which was missing from my previous e-mail.

Dear British Waterways,

Thank you for the information provided.

However, I note that you have failed to provide a copy the
following documents -

Chief Executives report
Minutes of Property Committee meeting
Minutes of Remuneration Committee meeting
Minutes of Nominations Committee meeting

Please provide the missing documents.

You have not met my expectations regarding this request so please
carry out a review as outlined in your last response. My concerns
are -

BW did not respond to my request within the timescale required by
law.

No reason was given for the delay.

BW failed to provide all the information requested.
