Dear Sir or Madam,
This is a request for information.
Please provide me with information:
(a) about the minutes of, and papers submitted to open SPSA Board
meetings since January 2009,
(b) about the minutes of, and papers submitted to, closed SPSA
Board meetings since January 2008.
Some information in (b) is out of scope of my request. You
therefore do not need to apply the public interest test if you
consider information could do harm to national security if it were
released, or relates to individual investigations being carried out
by the SCDEA. I would not expect such information to be discussed
anyway, but hope this goes some way to help. If I can be of any
more help, please let me know.
Please also provide me with information about procedures you have
about informing the Information Commissioner of a breach of the
Data Protection Act 1998.
Please provide a copy of the information, in an electronic format.

Dear Ms Wilkin,
Thank you very much for your reply.
Can I make a suggestion - the reason I asked for open Board papers
was because they didn't seem to be published on your online
publication scheme. I'm sorry I asked for them given they were on
another part of the website, but it may be an idea to copy them to
the scheme, to avoid other people making the same mistake!
On the closed Board papers, I accept what you say, though would
have liked more reasoning on why it's going to cost more than the
£600. I think this is required by OSIC.
However, can I ask whether asking for a digest of the relevant
papers (name of paper, date of meeting), then giving me the chance
to pick the ones I would like to ask for would, in your estimation,
fall below the limit?
This is too a suggestion on a more general level - if you were to
publish this list, and update it like the Scottish Parliamentary
Corporate Body, people are able to pick out the ones they want
instead of being forced to adopt a scattergun approach, which only
makes work.

Dear Ms Wilkin,
Thank you for your message.
I was disappointed you chose not to respond to my suggestions for
impriving your FoI practice. I had hoped an informal approach would
have met with a proactive response.
If you wish the response to become more formal, I shall provide
such a formal response:
Firstly, I request an internal review under section 20 of the Act
in relation to computation of fees. I do not consider you followed
best practice, as set out in Decision 154/2007 Andrew Picken
(Evening News) and Robert Seaton and the City of Edinburgh Council,
by failing to provide advice and assistance about how I may reduce
the scope of my request.
Furthermore, I consider you failed to justify the level of fee
appropriately. In the light of paragraph 7 of Annex 3 of the
Scottish Ministers' code, issued under section 60 of the Freedom of
Information (Scotland) Act 2002, I request such a review.
The second element of this email is a new request for information.
Please provide information about the minutes of, and papers
submitted to, the SPSA Board. This should be a digest of the
relevant papers (name of paper, date of meeting) placed before the
Board in 2009 and 2010.
Please provide this digest in electronic format.
I may say that if you are unable to provide me with a digest that
falls within the Fees Regulations, this indicates a serious lapse
in records management.
I therefore give notice that should that take place, I will inform
the Scottish Information Commissioner as part of his records
management role, my councillor for submission to my police board
and my MSP for contact with Ministers.
I am extremely sorry the SPSA feels it necessary for me to go down
this formal path, but I did give a chance for the Authority to be
helpful. I shall reserve my position on the issue of proactive
disclosure.
