minutes and briefing notes are published following the next Board
Meeting."
Please provide the following information -
1. Confirmation that the policy (above) was altered by the board at
its meeting on 16th July 2009 to provide minutes within "a few
weeks" of the meeting rather than an unspecified time after the
following meeting.
2. An explanation as to why the BW website has not been updated to
reflect the new policy.
3. An explanation as to why only briefing notes in the form of the
chief executives report are provided when board minutes are
published rather than all reports.
4. An explanation as to why sub committee minutes noted at board
meeting are not published prior to or at the same time as full
board minutes.
5. Please also provide, via whatdotheyknow.com, a copy of all
reports, sub committee minutes and other documents mentioned in the
minutes of the board meeting to be held on the 28th January 2010
which are not published with the minutes.
(With regard to request 5 - I have previously asked that the board
gives consideration to making this information publicly available.
However, it would appear that this request has not been put to the
board)

As you did not do so, I requested an internal review on 23rd

When requesting a review, I pointed out that board minutes (to
which this request refers) still remain unpublished on your website

board minutes which has been outstanding since 25th January despite
the requirement for you to respond within 20 days.

To date (and after some five months!) I have only received a
partial response my request, despite the intervention of the
information commisioner office.
May I ask that you provide me with a response to parts 1,2,3 and 4
and also the full (unredacted) information information requested in
part 5 within the next 48 hours.
In responding may I remind you of you of the HM Treasury document,
Reforming Arms Length Bodies (March 2010) which requires you to
publish extensive financial and performance information and be more
transparent and also the requirements and guidelines of the FoIA.

This e-mail is in reply to yours of 8 June 2010 sent at 07:33. The
response of British Waterways (BW) is made by reference to the questions
as numbered in your message.
1. The obligations of BW in respect of publication of Board Minutes arise
under the Publication Scheme adopted by BW in accordance with s.19 Freedom
of Information Act 2000. BW has adopted the Model Publication Scheme
prepared and approved by the Information Commissioners Office. That
Publication Scheme states that "The classes of information [to be
published] will not generally include: ...Information in draft form."
Until the minutes of a Board meeting are approved at the subsequent Board
meeting, they are in draft form. Therefore there is no obligation placed
on BW to publish minutes before they are approved by the Board. At the
meeting of the Board in July 2009 the Board considered a proposal to
publish draft minutes notwithstanding there is no legal obligation to do
so. That proposal was approved by the Board subject to the requirement
that the draft minutes should have been seen by the Chairman and all Board
members be given an opportunity to comment prior to publication. This was
a change of practice and not adoption of any kind of formal obligation.
Hence the deliberate vagueness of the minute indicating that the aim was
to enable publication "within a few weeks of the meeting".
2. A request for "an explanation" is not a request for information
within the meaning of the Freedom of Information Act 2000. Nevertheless I
am able to inform you that following the change of practice it was found
that the time taken to produce the draft minutes and to circulate to all
Board members and take into account their comments prior to publication
was quite variable depending on the availability of Board members
following a Board meeting. For example, following the March 2010 Board
meeting the process took longer than usual because of absence abroad of
secretariat staff, the Board Chairman and Board members at different times
over the Easter holiday period. This is an inevitable consequence of an
entirely non-executive Board (as appointed by government) with limited
time to devote to BW business in the light of their other private and
business commitments.
3. A request for "an explanation" is not a request for information within
the meaning of the Freedom of Information Act 2000. Nevertheless I can
inform you that the information published routinely is that covered by the
Publication Scheme. Because BW is required by statute (s.134 Transport Act
1968) "to act as if [it] were a company engaged in a commercial
enterprise" in respect of many aspects of its business, considerable parts
of Memoranda put to the Board in advance of decisions is exempt
information for Freedom of Information Act purposes. Other exemptions
often also apply under sections 22, 33, 35, 36, 40, 41 and 42 in addition
to that under section 43. These make such documents unsuitable for
routine publication under the Publication Scheme though they are still
disclosable (subject to appropriate redaction) in response to written
requests for information.
4. The reasons are the same as above.
5. The request for information in respect of the January 2010 Board
meeting has now been answered."

Your information request to British Waterways
Thank you for your correspondence dated 14 April 2010 in which you complain about British Waterways’ failure to respond to your information request dated 25 January 2010.
In your complaint you ask that the same case officer deals with this complaint as your previous complaint under case reference number FS50299370. As yet, although your case has been allocated to a casework team, no individual case officer has been allocated to deal with your complaint. As a non-response case this is an issue dealt with by the Freedom of Information Case Reception Unit and so I am responding to this complaint.
We note that the other request for information you refer to dated 13 April 2010 has now received a response from British Waterways.
Request for information dated 25 January 2010
In cases such as this the Commissioner does not consider that serving a formal decision notice would serve any strong public interest. However, I have written to the public authority to provide them with a copy of your original request, reminding it of its responsibilities and asking it to respond to you within 10 working days of receiving our letter. I attach a copy for your information.
As you will see, even though the Commissioner does not intend to issue a formal notice in this case, your concerns have been taken seriously. Thank you for bringing this matter to the attention of the Information Commissioner.
If British Waterways responds and refuses to release the information you have asked for and you are dissatisfied, you may, after exhausting their internal complaints procedure, complain to us again.
