Dear Sirs
Please provide the following information under the Freedom of
Information Act 2000.
There are restrictions placed on those working in the Police Force
regarding membership of the British National Party. Does your force
have any restrictions on a member of your Police Force:-
a) donating to the British National Party?
b) subscribing to a British National Party publication?
c) purchasing goods from the British National Party?
d) signing a petition in favour of the British National Party?
e) signing a nomination form for a British National Party
candidate?

Dear Mr Walker,
FREEDOM OF INFORMATION ACT 2000
Thank you for your request for information, received 01 December
2009 concerning BNP.
Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, as defined by the Act, subject
to the application of any statutory exemptions. Where consideration is
being given to the application of any exemptions the 20 working day
timescale may be extended under the terms of the Act to a period
considered reasonable depending on the nature and circumstances of your
request. In such cases you will be notified and, where possible, a revised
time-scale will be indicated. In all cases we shall attempt to deal with
your request at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information requested, where the request exceeds the statutory limit.
In such cases you will be informed in writing and the 20 working day
timescale will be suspended until we receive payment from you or your
request is modified and /or reduced. If you chose not to make full payment
or modify your request then the request will remain unanswered.
Your request may require either full or partial transfer to another public
authority. You will be informed if your request is transferred.

Dear Mr Walker
FREEDOM OF INFORMATION ACT 2000
Thank you for your request for information received 01 December 2009
concerning membership of the British National Party. This request has been
handled under the Freedom of Information Act 2000.
The only recorded information we hold relevant to your request is our
British National Party Policy on Membership which was sent to you on 3
December 2009.
However you should note that the circumstances surrounding any potentially
inappropriate behaviour will be investigated and treated on a case-by-case
basis. Dependant on the circumstances a member of the service could commit
other discipline offences, such as discreditable conduct, by taking part
in any of the activities outlined in the request. This is true of any such
allegation being made and is not specific to the BNP. It is simply the
standards of professional behaviour that all employees have to adhere to.
Staff take up employment with the police service fully aware that there
may be certain restrictions placed on their private lives, these are
designed to bring about greater public confidence and are based on best
practice drawn from ACAS and represents a culture of continuous learning
and development.
Your attention is drawn to your right to request a re-examination of your
case under West Midlands Police review procedure (attached). Please note
that such an appeal must be received within six months of the date of this
correspondence.
