Dear Basingstoke and North Hampshire NHS Foundation Trust,
Thank you very much for all your previous FOI responses.
I would like to make a request under the FOI Act.
For the purposes of the Act, please take the date of your receipt
of this request as Friday 1st April 2011.
Back in January 2009, I requested information from you regarding
BNHFT sending clinical feeds to the Hampshire Health Record
database.
Your response

stated that:
"The Trust is proposing to join the Hampshire Clinical Data
Repository (HCDR) in the next financial year."
"The Trust has not started to make visitors aware of the HCDR. The
development of a communication plan would form part of the
aforementioned formal project."
"Ensuring that the appropriate {opt out] forms are readily
available would form part of the aforementioned formal project."
I asked again in May 2010 about your plans to join the HHR.

You response then was:
"The Trust did not join up to the HCDR/HHR during 2009/10 although
discussions are continuing with the PCT."
So here I am again in April 2011.
• Please could you state whether BNHFT did indeed join up to the
HHR between April 1st 2010 and 31st March 2011
• Please could you confirm the date that BNHFT started feeding the
HHR with patient data, or the date that BNHFT will start feeding
the HHR with patient data if it hasn't yet started to
• Please could you kindly send me your HHR communication plan,
which ensures that (amongst other things):
* BNHFT is making visitors aware of the HCDR/HHR feeds via posters
and leaflets and your web site, and of their right to opt out
* Opt out forms are freely available from the hospital or
downloadable from your website
• Please could you kindly send me a copy of your opt out form, or a
link to it
As per Section 4a of Part 1 of the FOI Act

) I would like the information in question held at the time when my
request is received (draft or otherwise), except that account may
be taken of any amendment or deletion made between now and the
latest time by which the information is to be communicated to me,
being an amendment or deletion that would have been made regardless
of the receipt of my request.
I would be grateful if you would be kind enough to send me the
requested information promptly and in any event not later than the
twentieth working day following the date of receipt of my request -
that is by then end of Thursday 5th May 2011.
If my request is denied in whole or in part, or specific items
within the responses are withheld from disclosure, then you must
justify all deletions by reference to specific exemptions of the
act, as per Section 17 of the Act

). Where you rely on a qualified exemption to withhold disclosure,
you are obliged to consider the public interest in your decision
and the refusal notice must explain not only which exemption
applies and why, but also the public interest arguments addressed
in reaching the decision.
I wish to receive the information by email; I believe such a
request would be reasonable in these circumstances. As per Section
11 of Part 1 of the FOI Act (

) I would be grateful if you would "so far as reasonably
practicable give effect to that preference"; if you determine that
it is not reasonably practicable to comply with this preference
then you are required by law to notify me of the reasons for your
determination.
I would be grateful if you would kindly acknowledge receipt of this
request as recommended by the ICO (“It would be good practice to
acknowledge receipt of requests and to refer to the 20 working day
time limit, so that applicants know their request is being dealt
with”).
