Bluestone project Grant

Dear Pembrokeshire Council,
With relation to the £1 million pounds loaned to the Bluestone
project.
Please could you answer the following questions:
1.What is the "commercial" rate as a figure please of the loan made
to the bluestone project as this has not been answered in previous
FOI request. Be very specific ie. detailed to the same level as in
presumably the original agreement is a % figure above base rate
etc)
2. What is the interest rate on the capital of the loan or is it
interest free ? Please be clear on this point.
2. What date was the money in part or in whole first drawn down.
3. What date will the loan start to be paid back ?
4. Have any payments been made ?
5. When is the expected completion of repayment of the loan ? ie
the agreed term of the loan.
6.Is this loan still secured ? ie against charge or property rather
than shares against the new company.
With regards to question 6 I am looking for a transparent answer
that leaves no doubts to exactly the current financial position. If
it is basically unsecured because the share option hasn't been
taken up yet (as previous response to FOI). Then please clarify.
If further information is required then please do not hesitate to
ask.

The answers that you have supplied I am grateful for and thank you.
However, it would appear PCC have forgotten to supply the following
information:
Q 1. Thank you
Q2. Unanswered and not clarified please answer original question
which date the grant was first drawn down dd/mm/yy format would be
just fine.
Q3.and Q4 Thank you which I assume means no payments have yet been
made but are due in 2011 please clarify.
Q5.Thank you.
Q6. Not completely clear despite request, this would indicate the
Council has now taken up the share issue.
This is not a new question, you have not clarified, please clarify.
I would appreciate you clarify very soon as I don't wish to trigger
a review but clearly there is information missing form very clear
questions.

Dear Neil,
Ref: question 6
With respect. PCC have not answered the question clearly despite
requesting from the start a clear reply.
For PCC's information: an extract from the dictionary "clear" in
context of the original question means " free from doubt or
confussion, or easy to see".
The dictionary definition for "subsist" is: vb.
To exist; To remain or continue in existence.
In the legal context of this charge and shares "subsit" is not
definative in expressing if the charge is still valid or shares
have been taken up. i.e. the documents to the charge may exist but
may not pertain to the current owners or benificieries of the loan.
We know from Companies house that the shares were issued in October
last year.
So, again, I ask for clarification and have re-worded to assit with
your response so as to establish free from doubt and easy to see,
as originally requested.
Does the Council (ie the TAX payers of Pembrokeshire) have a valid
legal charge on the concerned property as of the date I originally
asked the question 12 January?
As PCC seem to be struggling with the concept of "clear". An answer
of YES or NO will suffice.
And as regards having taken up the equity shares, (at the time I
asked the original question), a YES, NO answer is what I need here
too.
I did expressly request that this was made clear and therefore do
not expect a delay in this clarification.
I hope this concludes the matter of "clearness" and of the of these
questions.
A prompt answer is required please.

Dear Pembrokeshire Council,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Pembrokeshire
Council's handling of my FOI request 'Bluestone project Grant'.
My original questions have not been answered "clearly" or in the
time frame set out in law.
This could easily be mis-constreewed as a delibrate attempt to slow
down the release of this information which is completely
unacceptable. On this basis I am requesting that this matter be
investigated in the interest of tax payers money as there is more
than a £1million pounds at stake.
