Dear Darlington Borough Council,

If the Council imposed a block on an email address from a
persistent complainant how often would they review this and when
would the block be removed. Would it be acceptable to leave the
block in place for 15 months without reviewing it?

Mr Sowerby
My local PA, the devon county council imposed a LIFETIME email ban back in 2005 without any appeal processs,without warning, with justification.
It would appear we are treading paralel paths,hence, please dont hesitate to contact me.

Mr Dransfield

Stockton Borough Council removed the block on my emails at the end of last year and sent a letter of apology for leaving the block in place without reviewing it. They also apologised for the length of time it took to remove the block once they had started the process. They also apologised on behalf of Tony Beckwith for his suggestion that whilst they were removing the block I should contact them through the WhatDoTheyKnow website regarding planning enquiries at my property which would have required me to put my personal details, including my home address on this public website.

The block was imposed because I didn't accept they had investigated safeguarding concerns at a care home. The care home in question was inspected 5 times by the Care Quality Commission in the 8 months after the block was imposed on my emails and the home was sent a 6 page warning letter listing 8 regulatory breaches.

They don't like anyone who upsets their "perfect" world, all local authoritys seem to forget who they actually work for, US and look down on "service users" as we are now called with distain, just dont push them too far as their is no length that they will not go to, using public money to silence you, I know! but have been legally gagged. The truth exposed hurts them. www.townliar.com

Please excuse the dual response.
I agree with both of you that local PA are below PAR with public complaints but the band of Merrymen is growing and I think before much longer the Central Government will have to act.My Email ban has just been lifted at the Devon County Council albeit restricted to one department contact only. The City Council are revieing their email ban and the HSE lifetime ban is STILL in place.
My own MP Ben Bradshaw is as useful as a chocolate fireguard on such matters and has refused categorically to meet me??!!

The ICO Solicitor has now informed me the total number of GHOST FOI requests from me to the DCC between Feb 05 and April 09 is NOT 11,it is only 8.
However, these FOI AND decisions are NOT yet in my custody.
It beggars belief the ICO were able to make a vexatious decision WITHOUT these ghost FOI requests and it also beggars belief the ICO were able to make an appeal against the FTT "NON/VEXATIOUS " DECISION??!!

It would appear the DCC CANNOT TRACE these ghost FOI requests. Whether or not they have looked in the dirty loft space at Topsham Rd, I know not??!!
We now have a situation where the 6 PFI schools FOI FTT hearing stands adjourned (mar 12)subject to the Test Case and it would appear the ICO Test Case has crashed on take off.
The integrity of the FOI Act 2000 is under the microscope in this TEST CASE and thats why the ICO are fighting this Appeal with such vigor because if they lose this appeal VEXATIOUS WHIM CARDS will be burned for ever.
