I am writing to request an internal review of Olympic Delivery
Authority's handling of my FOI request 'birds on East Marsh and the
Old River Lee'.
A full history of my FOI request and all correspondence is

In your response <20091126 EN00426.pdf> you state that the results
of a bird survey made on East Marsh for which you possess data is
being witheld until it is redrafted for release on December 4th.
You will be aware that the ODA has made the proposal for the siting
of a wind turbine on East Marsh, and that this matter is currently
the subject of a public consultation ending December 14th. It
appears to me that by withholding this data you are hindering the
possibility for this consultation to proceed in a transparent and
accountable manner.

Dear S Dowding,
The ODA confirms receipt of your representations under Regulation 11 of
the Environmental Information Regulations (EIR) for the ODA to
reconsider the response to your EIR request (EN00426) sent to you on
26th November 2009.
The EIR's set out that a public authority must consider and notify the
applicant of the response to their representations no later than 40
working days after the date of receipt of the representations.
As set out in our response to your EIR request the document you are
asking us to consider disclosing will be made available to you once it
has been re drafted on 4th December 2009. In any case, the document
will be provided to you before the ODA are likely to be able to consider
and respond to your representation for consideration.
As the information will be provided to you on or shortly after 4th
December and before the public consultation you refer to which is taking
place on 14th December, please can you confirm whether you would like us
to proceed with our internal procedure for reconsidering our response to
your EIR request.

Dear Information Officer,
I confirm that I wish to you proceed with an Internal Review. As I
have pointed out, a consultation has been underway, and whilst it
is correct that it runs until December 14th, it is also the case
that it has been underway since October already. As such one might
have expected such data to have been placed into the public domain
in advance of a consultation starting.
I would contend that if you are unable to place your 'report' into
the public domain immediately then you should as at least make the
raw data available immediately.

you on or shortly after 4th December". Furthermore in your text you
appear to be under the impression that the consultation is taking
place on 14th December, which is not the caes, the consultation
ends on that date and as I've alreadt written has been ongoing
since October.

Dear Information Officer,
Thankyou for the survey data you released from the study you
commissioned on East Marsh in 2008, and for the earlier data on
Black Redstarts.
However, locals are aware of other activities taken on behalf of
the ODA, for example the firm 'Land Use Consultants' are known to
have undertaken observations in 2007 looking for kingfishers from
the former access bridge to Manor Gardens Allotments and Carpenters
Lock.
May I please re-iterate that my request was not solely for East
Marsh but also for all data relating to birds for the length of the
Old River Lee through the 2012 Olympics site to Old Ford Lock. I
imagine given the claimed sustainability credentials of the 2012
project that more data exists and is stored in an easily
retrievable form which you will be able to release.
