Benefit entitlements for those who are in prison

Daniel Rhodes-Mumby made this Freedom of Information request to HM Prison Service

The request was partially successful.

From: Daniel Rhodes-Mumby

22 March 2010

To whom it may concern,

I would like to request some information related to prisoners'
benefit entitlements under the Freedom of Information Act (2000).

1) Which welfare benefits are prisoners of all kinds entitled to
claim, and are there restrictions depending on the claimant's
circumstances?

2) In addition, how many prisoners are currently claiming each of
these benefits? What is the take-up rate of those who are known to
be eligible for each benefit?

3) Are any of these benefits solely restricted to those within the
prison system? If so, which?

4) What is the weekly rate at which each of these benefits are
applied?

5) What is the total cost of these benefits to HM Prison Service?
If known, what is the cost also to other departments of HM
Government?

6) What are the perceived benefits of prison welfare payments? Has
any research been commissioned or used by HM Prison Service to
investigate this and, if so, which?

7) Lastly, what information and guidance are prisoners given with
regard to their welfare entitlements within prison?

Particularly for the last, if specific documentation exists then I
would be appreciative if this were also attached.

I express my gratitude in advance of your response.

Yours faithfully,
Daniel Rhodes-Mumby

Dear Mr Rhodes-Mumby,

SUBJECT: Freedom of Information Request

Thank you for your correspondence of March 22, 2010, in which you asked
for information regarding what benefit entitlements prisoners have under
the Freedom of Information Act 2000 (FOIA) from the Ministry of Justice
(MoJ).

You will receive a response from us by April 21, 2010. Your request has
been passed to the appropriate business unit within the MoJ, and they
will write to you with their decision by this date.

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest
test. If the information you have requested is covered by a qualified
exemption(s) under FOIA, the Department is allowed to take longer than
20 working days to respond. This is because in such circumstances we are
required to consider the public interest issues when deciding whether or
not to disclose the information requested.

If more time is needed to consider the public interest issues under a
qualified exemption(s), we will write to you and inform you of the
revised date you can expect to receive a response to your request.

If you have any queries regarding this request please do not hesitate to
contact us. Please quote ref: FOI/64289/10 in all future correspondence.

Yours sincerely,

Hannah Law
